The problem arises where the “trust” is self settled…. Ie a Trustor is
also the beneficiary. If a third party non spouse is the beneficiary then
should be no problem whether the trust is a testatmentary trust, an
intervivos trust or a RLT.

I have been told that a testatmentary SNT can only be created by will.
I've been doing some research and am confused now. Can a SNT also be
created under a RLT agreement? (I.e., after surviving spouse dies, if any
of the children are receiving needs-based assistance, the trustee may put
their share into SNT.)
