Hi Ashley:

 

Here are a few things I have done in similar circumstances:

 

1.       Contact attorney who drafted the Will to see if he or she kept a
list of assets in his/her file

2.       Review decedent’s tax returns (including back-up data) 

3.       Call insurance company to see if they will tell you how the
decedent paid the bills (direct deposit or check—will they disclose which
bank?)

4.       Ask close friends/relatives

5.       Have mail forwarded to the PR’s house

6.       Go through all paperwork in the decedent’s house 

7.       Call around to banks located nearest to decedent’s house or place
of work to see if decedent had accounts there

8.       Call decedent’s former place of work to see if decedent had
retirement accounts

 

If the brother is a beneficiary of the estate, and will not allow the PR
to have access to the house, you will probably need to initiate a TEDRA
proceeding so your client can gain access to mom’s house.

 

Good luck---these types of estate are challenging, but interesting.

I have a client who is named PR in his mother's will. However, he has had
no contact with mother for a few years. Besides her house (which is paid
off), he is unsure of what other assets she had (bank accounts, etc.)
Client's brother has been living in mom's house and is living there still
and will not be cooperative. 

What is the procedure when the assets are unknown?
