Subject: [WSBAPT] getting bank to clear title - auto
Hello,
One of my probate clients owns an automobile. The title to the car is in
the name of the client and the now deceased spouse. The auto was financed
by Big Bank and paid off over three years ago. However, before the loan
was paid off, Finance Company A purchased the car loan.
The car title still list Big Bank as a lienholder; however Big Bank
refuses to assist in having the title cleared. Finance Company A keeps
directing the client to go to a website, which requires a credit card
payment and no guarantee that the title will be cleared. (Since the
Finance Company is not referenced on actual title.
Anyone dealt with this type of situation? What options are available to
force Big Bank to remove its name from car’s title?
Thanks!
Sincerely,
G. (Gus) Benjamin Lindsey III
