Yes and no--You can't issue one as a matter of course because the Civil
Rules of Procedure don't apply to a probate--a probate is an
administrative action only. BUT it's simple enough to get permission, via
an ex parte motion showing good cause to allow issuance of subpoenas. See
RCW 11.96A.115(2)
<http://apps.leg.wa.gov/rcw/default.aspx?cite=11.96A.115> . I've done it a
couple of times when a bank has been unhelpful, and I've never had a
problem getting the court's permission to issue subpoenas.
