You might use the Will to refer to it and say it has been rescinded. I am
just thinking that would help clarify their intent when they were not here
to advise us.

Is there any advantage that you can see to holding it in limbo for use in
the future?

If the trust was never funded. Why do you have to do anything?  It is just
a “dry trust,” an empty shell.  Just set up their new estate plan.

I have an estate planning client who I believe was swindled in the late
90’s in AK by a CPA and “lawyer”.  Anyway, they recorded a trust in North
Star Borough, but it was never funded, they no longer live there and they
have no property there.  They no longer feel the need to include trusts in
their estate planning.  I will do a new will package for them, but am
clueless as to “unwinding” the AK trust.  I would like a completely clean
slate for them and their PRs when the time comes.

 

My brief surface research indicates that effective registration is
actually filing in Superior Court and not recording with the local borough
clerk.  Can anyone tell me more about this?  Can I just record a
revocation (assuming it’s not been filed in court)?  Perhaps I would need
to associate with an AK lawyer for this?

 

Any words of wisdom would be appreciated from this wise group.
