[WSBAPT] IRS and creditor claim

Marcus: In one probate, I moved for a family allowance, the IRS removed the
case to District Court. After discussions with the US attorney, they had it
remanded to state court and dropped the objection. In the second one, I had
a tax lawyer seek an opinion, and the IRS allowed the family allowance.

Marcus: I have had two cases where the IRS has allowed the family
allowance.

IRS has filed a late creditor claim in probate proceeding (no real property
to lien). Is the IRS subject to our 4-month creditor filing bar? If not,
anyone successfully litigate a family allowance claim to trump the debt owed
to the IRS?
