There may be an ongoing  police investigation or one by the federal
DEA.  I would call them and see if there is an investigation and,
assuming that they are taking some action, they take the load off your
client's back.  But I am not sure about the forfeiture laws.  I suggest
you get in touch with an attorney who does work in that area to see if
you will have a problem.  If I were representing the buyer and there was
no disclosure, I would likely sue your client as this is a material
fact, especially if there is a chance of forfeiture after the sale.

Dear All:

Client wants to sell his condo but there are following issues.
What type of Form 17 disclosures should be made as a seller to a buyer?

1.  More than a reasonable suspicion exists that the unit above his unit
is a crack house, and that buyers take meth there with occasional meth
parties. 
2.  The reasonable suspicion is derived from his experiences of noises
from the unit above his unit; no visual evidence exists.  For example,
sometimes a drag taker throws away furniture as a reaction of taking
drugs, which is a typical reaction of taking meth.  These are
extraordinary noises.
3.  Since there are no evidence, putting something on the form 17 might
involve libel law suit from the resident at the preblematic unit.
4.  There is a possible lawsuit from the buyer if enough disclosures are
not made.
5.  Client does not want to involve HOA as the drag dealer is possibly
linked to a foreign drag cartel.  Client wants to avoid any retaliation
from them. 


I would appreciate any suggestions in this situation.
