I would recommend against waiving bond. Comm'r Velategui has said
repeatedly (and with a certain amount of satisfaction) that in that kind
of situation (intestacy, multiple heirs), it's basically a slam-dunk for
the heirs to recover from the attorney's malpractice carrier if the bond
is waived and then the PR misappropriates money or otherwise acts against
the heirs' interests--or fails to pay creditors.

 

The cost of the bond, even if it's $100,000 coverage, isn't much over
$500--far better than small expense to the estate than taking any risk.
Bond is kind of an administrative hassle compared to no bond, but worth
the effort.

I am starting my first intestate probate and was wondering how difficult
it is to get bond waived? I will be getting waivers from all heirs. The
estate has assets close to $300K with known debts at about $5K. This will
be in King County.
