What if there is life insurance that, with all else, takes it over the
$125,000?.  Is the insurance protected as it passes outside of probate?

Note that the Petition can ask for more than $125,000 in the right
circumstances. The Court is supposed to consider the long term finances of
the surviving spouse. The statute has several factors for the court to
consider. I have had success with an Order that awards all of the equity
in the home and all of the liquid assets as of the date of death. Usually
there is a reduction in household income with the death that I point out
plus any continuing costs like house payments, etc. that are not reduced
because of the death.

A Petition for Family Award should wipe out all unsecured claims to the
extent that what the SS receives resulting from D's death doesn't exceed
$125,000.
