While not necessarily unethical per se, as a practical matter I would
confirm with my malpractice insurance carrier that I’m covered in such a
fiduciary capacity before taking on that role (I know my insurance at one
point specifically didn’t cover it).
I live in a relatively remote area, with an older population often not
living close to relatives, and have been asked on occasion to be the PR.
After explaining the issues, and the fact I’d likely be able to assist the
nominated PR as their attorney should they so desire, to date we have
always been able to name a third party. I have enjoyed this discussion.

I am a plaintiff’s PI/wrongful death attorney and also have a
probate/estate practice. I regularly serve as a PR/Administrator in
estates where a plaintiff or defendant have died, whether related to the
tort or not. In this capacity, I charge $200.00 an hour v. my normal rate
of $300.00 per hour. Most estates are accomplished for less than
$4,000.00 unless there are complications with debts or assets. I spoke at
a WSAJ seminar and provided simple instructions on how the probate works
in Washington State. I don’t see anything unethical about serving as a
PR/Administrator and handling a deceased person’s affairs.
The suggestions provided below are also good alternatives but I don’t
think it is unwise or unethical for an attorney to serve in such roles.

If they won't have a family member and don't have a trusted family friend
who's willing to step into that kind of minefield, then I'd suggest a

guardianship fiduciaries would do it--for example, Ohana

<http://www.ugswa.org/> . In the past, I've had the client contact the
company/companies and talk to someone there, so they're comfortable with
the choice (and make the choice themselves).
Sometimes the client, after exploring the projected costs, decides that a
family member isn't such a bad option after all.

Good morning,
PC’s are a married couple. PC’s estate seems relatively straightforward
from a planning/needs perspective. However, PC’s are very leery of having
either PC or a family member serve as personal representative for either
spouse’s estate. (Apparently one of the PC’s had a bad experience while
acting as a PR. I think the way the estate was divided caused the hard
feelings more anything related to the PR role.)
PC’s current position is that they want “an attorney” do serve as the PR.
At this point, I do not believe the value of the estate warrants hiring a
professional estate administrator; but perhaps that’s a consideration
assuming the costs are reasonable. (I’ve never used one.)
What have others done in situations where a client, for whatever reasons,
just did not want a family member to serve as PR? Has anyone actually
agreed to serve as the PR in a similar circumstances? (Obviously that
means a different attorney would have to take on the role of attorney for
probating the estate.)
Just looking for some ideas in case PC’s do not alter their position after
our initial discussion.
