The period of ineligibility is determined by taking the total of all gifts
made during the 60 month before applying and dividing by 267.The no of
days of ineligibility is the result of this division. However there is no
penalty regardless of when the gift is made if you can prove that it was
not made to qualify for Medicaid. See the Pamphlet put out by the
Northwest Justice Project called “Questions and Answers on Medicaid for
Nursing Home Residents July 2014”

Subject: [WSBAPT] Medicaid lookback period

Is the lookback period for gifts still 5 years to qualify for Medicaid?
These would be non-trust, direct gifts.
