Subject: RE: [WSBAPT] Minor Beneficiary of Life Insurance

In a very similar situation here in Snohomish County I was able to get an
order appointing the father as the financial custodian for the funds that
have been left to his minor child. (The funds were left by the child’s
grandmother.) As in your case, the insurance company insisted that a
guardianship was needed; however they release the funds to after receiving
a certified copy of the order. I drafted a short petition citing RCW
11.114, a declaration from my client (which included the plan to place the
funds in a locked account, how the account would be titled, fiduciary
duties, etc.) and a proposed order.

Although I’d been warned that the Court may require a guardianship, in
this case the judge did not have any issues with a financial
custodianship.

Sincerely,

Subject: [WSBAPT] Minor Beneficiary of Life Insurance

Good afternoon,

A friend’s 12 year old daughter was named the beneficiary on a $20,000
life insurance policy. There was no mention of UTMA or a custodian for
the funds. The 12 year old was simply listed as the beneficiary. The
insurance company is telling my friend that she has to get letters of
guardianship to access the funds. Is there any other way to get the funds
other than guardianship? And, if not, would this require a guardianship
petition under RCW 11.88 complete with a GAL appointment?

Thanks in advance!

Rebecca King
