Are you speaking of a Title Company’s Lack of Probate Affidavit?

>From a title insurance perspective, the passage of time does not impair
the utility of the lack of probate affidavit.  We would review the
affidavit to determine whether the wife’s interest passed to the husband,
and if all looks well, pass title through to the trustee of the trust.

If Husband puts real property into Revocable Trust without probating
Wife's interest in 1990,  will an affidavit of non Probate executed now be
effective when H dies? Any other way to avoid probating her estate? Thanks
