Perch Request for Letter from Council Allowing Beer and Wine License Within 300 Feet of A School or Church Per Idaho Code 23-913 - Gary J. Riedner</b></div><div>Idaho Code § 23-1011B and 23-1307A, prohibits any business from selling beer and/or wine for on- premises consumption within three hundred feet (300') of any church, school or any other place or worship, unless the City Council approves a waiver of the requirement.</div><div><br></div><div>The Perch is an establishment located at 509 University Avenue within the University of Idaho campus and within three hundred feet (300') of the LDS Institute site located at 902 S. Deakin Street, as well as the Campus Christian Center located at 822 Elm Street. The Perch is currently licensed to sell packaged beer and wine for off-premises consumption only.</div><div><br></div><div>On July 21, 2014, Paramjit Singh, operator of the Perch, requested the City Council to waive the 300 foot minimum distance requirement in order to sell beer and wine for on-premises consumption. The Perch is located in a Neighborhood Business Zoning District under Moscow City Code § 4-4-3. Restaurants are permitted in the NB zone, while bars are prohibited. At that time the applicant represented that the establishment was being remodeled to operate as a restaurant. The City Council declined to waive the 300 foot minimum requirement and indicated that if the Perch established itself as a restaurant, the applicant could petition to come before City Council and again request a waiver.</div><div><br></div><div>On March 9, 2015 and April 13, 2015, Mr. Singh again appeared before the Administrative Committee of the City Council requesting a waiver of the 300 foot minimum in order to sell beer and wine for on- premises consumption.
