<p> I remember hearing about the terrorist's rights being not read/read on the news... Pardon my C&P. Some of these facts were swimming around in my head, but to get them right, I had to look it up.</p><p><strong></strong></p>
<p><strong>Police can use statements defendants made without getting
Mirandized if they need to question a suspect in order to protect the
public's safety</strong>, <a href="http://supreme.justia.com/cases/federal/us/467/649/case.html">the Supreme Court ruled in 1984.</a></p>
<p>In October 2010, the FBI <a href="http://www.justice.gov/oip/docs/ag-memo-miranda-rights.pdf">issued a guidance</a>
for how to apply this "public safety exemption" to terrorism suspects.
The memo noted that "an arrest of an operational terrorist may warrant
significantly more public safety interrogation" than ordinary criminal
cases.</p>
<p>While that guidance would seem to apply to the Boston marathon
suspect, the decision not to Mirandize him right away has spurred a
debate over the rights of terrorism suspects.</p>
<p>Anthony D. Romero, who heads the American Civil Liberties Union, <a href="http://www.nytimes.com/2013/04/21/us/a-debate-over-delaying-suspects-miranda-rights.html">told The New York Times </a>the FBI should only be questioning the non-Mirandized Tsarnaev about imminent threats like other bombs that might be planted.</p>
<p>“The public safety exception to Miranda should be a narrow and
limited one, and it would be wholly inappropriate and unconstitutional
to use it to create the case against the suspect,” Romero told The

I can't figure out why a judge would think that the bomber wouldn't need to have his rights read to him, too. I can only assume it has something to do with the Patriot Act. They may indeed have set it up inadvertently to get this guy off. And if they had found him inside a house in which they didn't have a warrant to search, then they might be in trouble as well. The lesson, of course, is to play by the book, not run off half-cocked because they are looking for a terrorist.<br>

<br></div><div>Is Gary's question hypothetical? Did someone actually refuse to allow a search? Either way, it is an important question. I am not a criminal and do not indulge in criminal activities. None-the-less, absent an extreme, extreme case, I would never consent to a warrantless search. I have a lot of private business that is no one else's save the transacting parties. Police discretion is not perfect, and in Idaho, very much less than perfect.<br>

police going door-to-door <br>in SWAT teams evicting the residents and
searching the houses. People <br>who know me can assume that I'm
outraged by this. Shut down an entire <br>city for two guys? Armed SWAT
team members pointing their guns at your <br>family? 9,000 cops in SWAT
gear and loaded for bear? Of course I'm <br>outraged.<br><br>But what
gets me is how the people just shrug it off. "They are doing <br>the
right thing." "They apologized for the inconvenience." "I'm so <br>happy
they are doing their jobs." How happy would you be if an accident
