I take it to mean that if you ever find yourself in a situation where you will literally die if you don't fight your way out of it, then it's better to be armed and survive than to be unarmed and die despite the impending court case which will follow. Notice that it doesn't mean that you should step into a situation you could easily have avoided, because then the comparison is between being judged by 12 vs. nothing at all.
