The fact that the ISP expert contradicted himself under oath in two different cases only came to light because the same lawyer in the state appellate PD office in Boise ended up assigned to both cases, and caught the contradictory evidence.<br><br>It is very rare for an appeals court to throw out a conviction in these circumstances.
