HOUSE OF REPRESENTATIVES<BR>HOUSE CONCURRENT RESOLUTION NO. 44<BR>BY STATE
AFFAIRS COMMITTEE<BR><BR>A CONCURRENT RESOLUTION STATING FINDINGS OF THE
LEGISLATURE THAT THE SCOPE<BR>OF POWER DEFINED BY THE TENTH AMENDMENT PROVIDES
THAT THE FEDERAL<BR>GOVERNMENT WAS CREATED BY THE STATES SPECIFICALLY TO BE AN
AGENT OF THE<BR>STATES, THAT CONGRESS IS URGED TO PASS LEGISLATION
IMPLEMENTING THE<BR>FINDINGS PROVIDED FOR IN THIS CONCURRENT RESOLUTION,
INCLUDING BALANCING<BR>THE FEDERAL BUDGET, EXTINGUISHING THE PUBLIC DEBT,
PROVIDING FOR<BR>GOVERNMENT TRANSPARENCY, MAINTAINING AN ENGLISH-SPEAKING
NATION,<BR>PREVENTING FOREIGN ENTITIES<BR>FROM HAVING AUTHORITY OVER
ACTIVITIES WITHIN THE UNITED STATES,<BR>RESTRAINING THE GROWTH OF THE FEDERAL
GOVERNMENT, PREVENTING UNFUNDED<BR>MANDATES, PROHIBITING GOVERNMENT FROM
TAKING OWNERSHIP OF PRIVATE SECTOR<BR>ENTERPRISE AND PROVIDING FOR THE
PRESENCE OF "GOD" IN THE PUBLIC DOMAIN,<BR>AND URGING THE SEVERAL STATES TO
ADOPT SIMILAR RESOLUTIONS.<BR><BR>Be It Resolved by the Legislature of the
State of Idaho:<BR><BR>WHEREAS, the scope of power defined by the Tenth
Amendment means that the<BR>federal government was created by the states
specifically to be an agent<BR>of the states, and<BR><BR>WHEREAS, it is the
desire of the Legislature of the state of Idaho, that<BR>Congress adopt laws
consistent with the findings hereinafter described,<BR>and<BR><BR>WHEREAS, in
regard to a Balanced Federal Budget and the incurrence of<BR>debt, the annual
expenditures of the Congress should not exceed the annual<BR>revenue for any
year, save for the use of monetary reserves, and that<BR>Congress should not
borrow from any source, including its own funds and<BR>trusts, for any
expense, except for the extraordinary costs of a declared<BR>war or armed
conflict, and<BR><BR>WHEREAS, in regard to Paying of the Public Debt, that all
Public Debt of<BR>the United States should be extinguished within 55 years of
the approval<BR>of this resolution, and<BR><BR>WHEREAS, in regard to
Government Transparency and Congressional<BR>Procedures, all bills, orders and
resolutions passed by the Congress<BR>should be limited to a single topic, and
After all floor amendments, no<BR>bill should be voted upon by either body of
Congress unless and until it<BR>has been published for general public review
for at least five days, save<BR>a Declaration of War, and<BR><BR>WHEREAS, in
regard to maintaining the United States as an English-Speaking<BR>Nation, the
English language should be the exclusive language for the<BR>affairs of
government and the formal language for business, and No<BR>business,
individual, or government should suffer any penalty for<BR>requiring the usage
of the English language exclusively in its affairs,<BR>nor should be liable
for not speaking another language, and for any<BR>domestic issue, no court
should consider or use as precedent any foreign<BR>or international law,
regulation, or court decision, and<BR><BR>WHEREAS, Congress should prevent
foreign entities, including the United<BR>Nations, from having authority over
activities within the United States,<BR>and<BR><BR>WHEREAS, in regard to
restraining the growth of the federal government,<BR>preventing unfunded
mandates and prohibiting government from taking<BR>ownership of private sector
enterprise, judicial interpretation of the<BR>division and the limits of power
contained in the Tenth Amendment should<BR>lean to the side of the states or
the people with the powers granted to<BR>the United States in Section 8 of
Article I being limited and narrowly<BR>interpreted. The behavior of courts
that do not honor this provision<BR>should be brought to question by Congress,
and The United States should<BR>not nationalize any industry save during the
time of declared war, after<BR>which control should revert to the private
sector. Should the United<BR>States gain controlling interest in a private
sector enterprise through<BR>default or by other means, the United States
should divest itself of such<BR>interest in an orderly manner,
and<BR><BR>WHEREAS, in regard to providing for the presence of "God" in the
public<BR>domain, no religious organization should be discriminated against by
any<BR>government. As a tribute to that which has endowed us with our rights
and<BR>provided a moral compass for us to follow, the phrase "In God We
Trust"<BR>should appear on all coin and currency and references to God should
be<BR>welcome in all public places and public verse, including the display
of<BR>historic symbols, which provided the foundation for the modern
day<BR>law in the United States.<BR><BR>NOW, THEREFORE, BE IT RESOLVED by the
members of the Second Regular<BR>Session of the Sixtieth Idaho Legislature,
the House of Representatives<BR>and the Senate concurring therein, that the
Legislature submits this<BR>Concurrent Resolution to the several states of the
United States and that<BR>the several states are urged to approve, on or
before March 1, 2010, a<BR>like or similar resolution as herein approved by
the Legislature of the<BR>State of Idaho.<BR><BR>BE IT FURTHER RESOLVED that
Congress is urged to pass legislation<BR>implementing the findings provided
for in this Concurrent Resolution,<BR>including those findings relating to a
Balanced Federal Budget,<BR>extinguishing the Public Debt, Government
Transparency, maintaining an<BR>English-Speaking Nation, preventing foreign
entities from having authority<BR>over activities within the United States,
restraining the growth of the<BR>federal government, preventing unfunded
mandates, and prohibiting<BR>government from taking ownership of private
sector enterprise, and<BR>providing for the presence of "God" in the public
domain.<BR><BR>BE IT FURTHER RESOLVED that the Chief Clerk of the House
of<BR>Representatives be, and is hereby directed to forward copies of
this<BR>resolution to the Secretary of State and presiding officers of both
Houses<BR>of the Legislatures of each of the other States in the Union, the
Speaker<BR>of the United States House of Representatives, the President of the
United<BR>States Senate, and the members of the congress of the United
States<BR>representing the state of
