purchased, or may have been granted permission by the publisher of Runner's
World, or the photographer to use the photo.</FONT></DIV>
<DIV><FONT face=Arial size=2>In addition, Palin may have signed a release
allowing Runner's World or the photographer to do basically whatever they
wanted with the photo, including selling it to other organizations.

<DIV><FONT face=Arial size=2>Even if she didn't sign one, they could have
bypassed any need for Palin's approval since it was used in an
editorial context.</FONT></DIV>
<DIV><FONT face=Arial size=2>Just because Palin is the subject of the photo
doesn't mean she has any rights to it's use, that right belongs with the owner
of the copyright.</FONT></DIV>
<DIV><FONT face=Arial size=2>If there was any infringement, that issue would
be between Newsweek and the copyright owner. Palin would have nothing to do
with it.</FONT></DIV>
