made to City Council to produce an ordinance prohibiting smoking in bars within
the City. Attached please find a first draft of an ordinance which defines the
word "bar" and prohibits smoking therein. It also establishes an
administrative "remedy" which allows a defendant to pay an
administrative fine within fourteen (14) days of receipt of the notice of
violation in exchange for a reduction in cost (for up to three [3]
violations). In the event the administrative fine is not paid within fourteen
(14) days, MPD will issue a Uniform Citation and file it with the Magistrate's
court. A person found in violation of the ordinance will pay an infraction
penalty of fifty dollars $50 for each conviction up to and including a third
conviction. A fourth conviction and above will result in a misdemeanor and a
probable fine of $188, with no jail time. Reviewed by the Sustainable
Environment Committee on June 16, 2009.</span></font><font
