Subdivision Code currently includes a provision that requires that parkland be
dedicated as part of any subdivision of property for development in order to
service the needs of the future residents and visitors of such developments.
The Code also provides for the opportunity for the developer to pay a fee in
lieu of the dedication of land where the circumstances of the subject property
or development warrant. Over the last few years, there has been some confusion
under the current Code as to whether the City has the ability to specify which
option the City believes to be in the City’s best interest, or whether
the developer was able to make that decision independent of the City. Staff has
prepared a draft ordinance for consideration (attached) that would clarify that
the City shall retain the right to determine whether to accept a dedication of
land or a fee in lieu of land for the Commission’s consideration. One
additional feature of the draft ordinance is the addition of a provision that
would allow the City to accept a dedication of land and improvements, thus
allowing the developer the option of providing a smaller but fully developed
park at the City’s discretion.<o:p></o:p></span></font></p>

employees the opportunity to participate in a Flexible Spending Account
pursuant to Internal Revenue Code Section 125(b). This plan is administered by
Manley and a copy of a summary plan description is contained in the Committee
packet. The use of the Flexible Spending Account is entirely voluntary by
individual employees and allows employees to utilize limited
"before-tax" dollars to pay the employee's share of certain medical
and insurance related expenses, such as employees' share of dependent health
insurance, medical and related expenses, disability and life insurance. The
amount of the employee's contribution is at the employee's discretion, up to a
maximum of $5,000 employee contribution per year. Any funds which are not
utilized by the employee are forfeited (use it or lose it) according to the
plan and the IRS code. The remaining funds are then refunded to the City. These
funds are generally included in the Refunds and Reimbursements line item in the
General Fund Revenue budget. In 2006, this refund amounted to $1,770.09. The
Employee Advisory Committee (EAC) would like to utilize these funds for the
purchase of a bench in <st1:Street w:st="on"><st1:address w:st="on">Friendship
Square</st1:address></st1:Street> as a memorial to Officer Lee Newbill, who
was killed in the line of duty on May 19, 2007. A memo from EAC Chair Patti
McKinney is attached. This expenditure was not included in the FY2007 budget,
so Council authorization is necessary for approval.<o:p></o:p></span></font></p>

of <st1:PlaceName w:st="on">Idaho</st1:PlaceName></st1:place> which is being
considered as a potential redevelopment project area by the Moscow Urban
Renewal Agency. All of the property owners in the area have agreed to fund the
major part of a preliminary planning process to assist in identifying potential
development of the property which will complement the area and serve to provide
linkages between the downtown and <st1:place w:st="on"><st1:PlaceType w:st="on">University</st1:PlaceType>
of <st1:PlaceName w:st="on">Idaho</st1:PlaceName></st1:place>. Kendig Keast
Collaborative (KKC) has submitted a scope of work to provide those services with
a focus on owner and community input. It is requested that the City of <st1:place
w:st="on"><st1:City w:st="on">Moscow</st1:City></st1:place> act as the
