Kerry is totally in error in her/his assessment.</FONT></DIV>

<DIV><FONT size=4>The process of granting the CUP to allow NSA (No Saints
Around) to remain in the CBD is far from complete:</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>1. The decision of the BOA is likely to be
appealed to the entire city council on legal and other grounds. Unlike the
BOA and the inept Community Development Director, the city council is
elected. Therefore, they may take a much different view than the BOA about
the effects on the entire city of granting the CUP. They may take a much
different view of the public policy ramifications of rewarding a serial zoning
violator by legalizing the violator's crimes. They may also take a much
different view of the legal principles involved.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>2. The city council's decision can be
appealed to district court.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>3. A district court decision can be appealed
to the Idaho appellate courts.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>4. Idaho appellate court decisions can be
appealed to the federal district court.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>5. Etc.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>6. Etc.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>At any point in the above process, the matter can be remanded
backward with instructions for reconsideration. Hence the process is far
from complete.</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>In addition to the zoning decisions at issue there are other
matters that might affect the ability of NSA to remain downtown. Consider
the following marketing/product quality related adages:</FONT></DIV>

<DIV><FONT color=#0000ff size=4>"You can't make a silk purse out of a sow's
ass."</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT color=#0000ff size=4>"You can fool some of the people some of the
time, but not all of the people all of the time"</FONT></DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4></FONT> </DIV>
<DIV><FONT size=4>However, the real enervation of NSA may be foretold by
the consideration of the following adage (and much more seriously and with
considerations of quantity) both in terms of NSA itself and the entire <FONT
size=6><FONT face="Olde English">Wilson & Family's Cult & <FONT
color=#00bb88><STRONG>Cash Machine</STRONG></FONT></FONT><FONT face=Verdana
