Natural Gas Company a fifty year franchise agreement for the distribution and
sale of natural gas within the City.<span style='mso-spacerun:yes'>
</span>The franchise was subsequently transferred to Washington Water Power
(now Avista Utilities) in 1958.<span style='mso-spacerun:yes'> </span>The
franchise agreement allowed for the payment of a franchise fee of 3% of gross
revenues which was then was subsequently increased to 5% in 1981.<span
style='mso-spacerun:yes'> </span>Subsequent to the establishment of the
franchisee agreement, state legislation was passed that limited future
franchise fees upon power, natural gas and water public utilities to no more
than 1% unless a higher franchise fee was approved by a majority of voters of
the city voting on the question at an election.<span
style='mso-spacerun:yes'> </span>Currently, gas franchise fees provide
the City approximately $250,000 in annual revenues at the current rate of
5%.<span style='mso-spacerun:yes'> </span>Staff would like to discuss the

</span>The realignment of </span></font><st1:Street><st1:address><font size=2><span
style='font-size:11.0pt'>West View Drive</span></font></st1:address></st1:Street><font
size=2><span style='font-size:11.0pt'> is necessary to make a better connection
of the two existing developed portions of the street located to the east and west
of the proposed plat.<span style='mso-spacerun:yes'> </span>A portion of </span></font><st1:Street><st1:address><font
size=2><span style='font-size:11.0pt'>Meadow Street</span></font></st1:address></st1:Street><font
size=2><span style='font-size:11.0pt'> would no longer be needed and is
proposed to be utilized as private lots and the public storm water detention

rights of way are vacated, they would revert to property to the east of </span></font><st1:Street><st1:address><font
size=2><span style='font-size:11.0pt'>Meadow Street</span></font></st1:address></st1:Street><font

and south side of </span></font><st1:Street><st1:address><font size=2><span

</span>All of this land is included within the boundaries of the proposed

City will retain right of way through this area, the vacation process should
not occur until the preliminary plat is reviewed and approved by the City
Council.<span style='mso-spacerun:yes'> </span>The plat will need to be
conditioned upon subsequent approval of the right of way vacation request.<span
style='mso-spacerun:yes'> </span>The consideration of the plat by the
City Council will occur on September 6<sup>th</sup> and, therefore, the plat
