They did apply for guardianship on several occasions but were denied by
the court. This conforms with Florida law, as I understand it, and
parents have no rights for their married children. I agree with that
law but I have a hard time with the court's refusal to accept
additional testing that the Schlindler's offered to pay for to be
entered into the record. Michael has repeatedly refused any additional
treatment or testing since the mid '90's. In fact, his custodial
duties were partially remanded to the court for his refusal to have
anti-biotics administered when Terri had a life threatening infection
some years ago. The court, under both Florida law and federal
precedent, determined that withholding of basic medical care is a
violation of basic rights. <br>

There are raging debates on the conservative side as to whether the GOP
overstepped its bounds in this case. If any of you can put on your

I'm obviously reluctant to point many of you there as I'm sure it will
do little more than bring contempt on myself for my conservative views
and my disdain for the new found federalism of the Democrats. I'm, on
this one, deeply skeptical about the courts findings and generally on
the side of the Schlindlers (note to Nick Gier - this may be
inconsistent of me as a libertarian and a federalist in many respects -
I don't want to hear about it - mia culpa) If you're deeply offended
(or otherwise) by what I have written feel free to add comments to the
blog. I leave everything there for public view unless it borders on
pornography (Hey, my kids read my site.) <br>

If anyone is curious as to the issues of the "Finding of Facts" in this
case, there is a very comprehensive review done by Reverend Robert
Johansen which was published on the National Review website last week at

Admittedly Father Johansen is bias toward keeping Terri alive in consort
with the Catholic Church. But as I have been following this case I have
come to understand much of what the Schlindler's have been saying about
the judicial proceedings and what they determine as blind intransigence
on the part of the Florida courts.
Also, the money that was awarded Michael and Terri Schiavo breaks
something like this. The total award was about $1.6 million. After
legal fees Michael received $300,000 and a medical trust was set up for
Terri with something just less that $900,000. Much of the $900,000 has
been spent on legal fees for Michael's cause which was authorized by the
Florida courts. I have no idea about life insurance, but if there is
any it is likely owned by Michael and therefor has not been subject to
public disclosure.
I also assume that my referring some of you to the National Review will
be dismissed out of hand as wingnut crap. Don't bother to send me email
telling me so. I'm not interested in knee jerk dismissals.

of knowing if it is the case that the husband or his children would
get money or not. Nonetheless, that does not mean that there are not

most is the attempts to demonize the other side. Most the people that
are saying keep her alive or end her life are saying so because they
believe that is the most loving thing to do, not because they wish her

On Nightline last night an attorney involved in the case said that the
Husband could not touch the lawsuit money in any way. The insurance
ran out
a long time ago. She is now on Medicare etc.
This whole thing is such a mess. My questions start with how did she get
this way to start with? Who made the medical decisions that put that
tube in
to start with? And it only goes downhill from there.

In following the Terri Schiavo story, I find it disheartening that good
people on both sides of the issue show such acrimony toward the "other
side". As well as I can discern, those who feel she should be kept
alive do
so out of compassion. And, those who feel she should be allowed to die
feel
that way out of an equal compassion. I happen to be among the latter,
though I have friends and family members who are among the former. All
good
people, with the possible exception of myself. If any public good can
come
out this tragic case, perhaps more people will be persuaded to write
living
wills, so it cannot happen to them. I intend to. I cannot imagine
enduring
15 years of "life" the way Mrs. Schiavo has.
