There are fights in American over restrictions for marriage license as 
well as restrictions on assault rifles.  On the former, if restrictions 
violating 5th amendment equal liberty or 14th amendment equal protection
 will be struck down.  On the latter, restrictions violating the 2nd 
amendment will be struck down.
