This, in my opinion, is simply a delay tactic to delay the decision until after November 6th when its impact is virtually nullified and the matter is swept under the proverbial rug with the rest of the ever-increasing pile of legislative crap.

Courts mull bid to move Idaho disclosure lawsuit

BOISE, Idaho (AP) - Idaho judicial officials are assessing demands by a group promoting public school chief Tom Luna's education overhaul to shift the legal fight over its donors' identities to federal court from state court.

Mid-Friday morning, a 1:30 p.m. hearing at Boise's Ada County Courthouse was still possible - but court officials said that could change quickly.

Late Thursday, Christ Troupis, the lawyer for Education Voters of Idaho, filed paperwork to move Secretary of State Ben Ysursa's lawsuit to U.S. District Court, from 4th District Court in Boise.

Ysursa has demanded that EVI disclose the identities of donors of more than $200,000 to broadcast ads promoting public schools chief Tom Luna's education reforms.

Troupis argues federal court is the appropriate venue to handle his client's constitutional claims that Ysursa's disclosure demands violate their free-speech rights.
