Federal court: Hart doesn't get lawmaker immunity
COEUR D'ALENE, Idaho (AP) - A federal judge has rejected an effort by Idaho state Rep. Phil Hart to claim legislative immunity in a federal income tax case.

The Republican representative from Athol has been fighting federal and state governments for years over income taxes, which he says are unconstitutional.

U.S. District Judge Edward said Tuesday that Hart couldn't use legislative immunity as a defense in the federal lawsuit because that only applies to "legitimate legislative activity."

The judge, however, moved Hart's trial up to November so it doesn't interfere with his 2013 legislative duties.

On Monday, Hart told the Idaho Supreme Court that his months-late appeal of a 2009 order to pay $53,000 in income taxes, interest and penalties should be allowed because the deadline overlapped with his service at the state Capitol. The state court has yet to issue its ruling.
