PRESS RELEASE
Title:  Handicap Plate and Placard Advisement

April 12, 2011 (Moscow, Idaho - The Moscow Police Department would like to remind our community of the proper use of handicap license plates and placards and the penalties for violating handicap regulations.

Use of a vehicle with an approved State of Idaho plate and placard is subject to all Idaho motor vehicle laws, but is allowed to park in any public parking space with metered parking without being required to pay any parking meter fee and allows the user to park in parking zones or areas which are otherwise restricted as to the length of time parking is permitted.

In certain instances, handicap parking privileges do not apply in posted fire lanes; or areas that are reserved for special types of vehicles; to areas where vehicular parking is prohibited for periods in excess of forty-eight (48) hours; or to areas where parking is prohibited for certain periods of time in order to allow snow removal, street construction or maintenance, or for other emergency purposes.

As stated in Idaho Code Section 49-410(9), State of Idaho permits may only be used by the person who meets the definition of disability as defined in the Idaho Code 49-117(7)(b).  Any use of a permit by someone other than the individual who obtained the permit may result in a fine of $100.  Any attempt to obtain a permit using false or fictitious information may result in a fine of $141.50.

As outlined in Moscow City Code 11-4-13, in Ordinance 86-22, and in compliance with the Idaho State 49-410, it is unlawful for any person to stop, stand, or park a vehicle in a designated disability parking space or area without a valid State of Idaho plate or placard.  This applies to both public and private parking areas which are properly designated spaces posted with, a sign consisting of the international accessibility symbol.  The area marked with blue lines next to a handicap space is provided for the use of loading and unloading for wheel chair access.  No stopping, standing, or parking is allowed in this reserved area.  Violation of this ordinance and law may be punishable by a fine of $200.

These restrictions apply on the University of Idaho campus as well.   The University of Idaho requires a separate handicap parking permit issued by their Parking Office when parked in handicap zones around their campus.  The University Parking Office does provide disability permits for individuals with a current state-issued disability permit.
