Hubbe Appeal of Day Care License Denial

On April 13, 2010, Mari Hubbe was denied a Day Care License pursuant to
Moscow City Code 9-10-8(B)(14) due to a violation of Idaho Code Section
37-2732(d). She appeals the denial to the City Council per Moscow City
Code 9-10-15.  (Denial overturned 6-0)

Paradise Creek Daylighting Project Flood Map Revision Participation Request

As the Council is aware, the University of Idaho and Army Corps of
Engineers are in the process of conducting a restoration project on
Paradise Creek within the City of Moscow. The proposed scope of work
includes channel enhancements within Reaches 1a, 1b and 3, and new channel
construction within Reach 2. The project design documents and associated
hydrologic and hydraulic analysis indicate that the project will
significantly reduce the width and overall size of the 100-year floodplain
within the project area, possibly to less than 25% of its current size.
While the Corps of Engineers is the agency overseeing the restoration
project, it is not within the project scope nor does the Corps of
Engineers assume any responsibility to update the Flood Insurance Rate
Maps (FIRM). Under the NFIP program the responsibility for maintaining and
updated the FIRM lies with the local jurisdiction. The University of Idaho
anticipated doing the surveying, documentation and calculations to support
changes to the floodplain within Reach 2, but did not anticipate doing the
same for Reaches 1a, 1b and 3. The area within Reaches 1a and 1b are
especially important to the City, as the proposed improvements to Paradise
Creek will remove most of the floodplain from the downtown area, including
the Legacy Crossing Urban Renewal District. The revision of the floodplain
map is a significant benefit to the City and property owners. City Staff
met with the University of Idaho staff who indicated that although they
did not anticipate doing the work for the revision of the floodplain map
for Reaches 1a and 1b, they would be willing to extend the professional
services contract with McMillien Engineering to include this additional
work, but would like some financial participation from the City. It is
estimated that the additional cost for the revision of the floodplain map
in Reached 1a and 1b is likely to be approximately $15,000-$20,000. Staff
recommends that the City participate in the amount of $5,000 to be paid
from the Community Development Department Professional Services line item
funding that had been anticipated to fund the Unified Code Project which
is now being completed internally by City Staff. Since the additional
survey work needs to be coordinated with the construction staking work
anticipated to begin in the next week, Staff was unable to bring this to
Committee prior to Council.

FAA Moscow-Pullman Regional Airport Grants

Congress has not passed the FAA reauthorization as of this date, which has
caused uncertainty and delay in the FAA’s Airport Improvement Program
(AIP) grants. At this point, FAA does not expect to issue grants until
July or August and they believe a very short turnaround will be required
for acceptance of grant offers. In anticipation of this situation, we
consulted with FAA and asked them if a pre-approval of the grant offer
would expedite the process. They responded in support of this action by
both the Cities of Moscow and Pullman. At this time we know that the
maximum possible grant for 2010 project will be $1,600,000. That amount
includes our 2010 entitlement grant of $1,000,000 and $600,000 in
carry-over funds from 2009. The Airport is requesting Council action to
authorize Mayor Chaney to accept one or more 2010 FAA grant offers up to a
total amount of $1,600,000. This was reviewed by the Public Works/Finance
Committee on April 26, 2010.
