[Vision2020] Schroeder Weighs in on Health Rule

Gee.

Last year State Senator Gary Schroeder and City Councilman Walter Steed
wanted to pimp Moscow's water rights.

This year, it seems, that Schroeder is flying solo in his attempt to dump
waste (waste that should normally be discharged into an appropriate septic
system) into North Idaho's lakes and streams.

This leaves only one question . . .

When is Schroeder up for de-election?  His constituency wants to know.

"IN THE SENATE
SENATE CONCURRENT RESOLUTION NO. 114
BY SCHROEDER

A CONCURRENT RESOLUTION
STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE
PUBLIC HEALTH DISTRICTS RELATING TO RULES OF IDAHO PUBLIC HEALTH DISTRICT
NO. 1.

Be It Resolved by the Legislature of the State of Idaho:

WHEREAS, the Legislature is vested with authority to reject executive
agency rules under the provisions of Section 675291, Idaho Code, in the
event that the Legislature finds that the rules are not consistent with
legislative intent; and

WHEREAS, it is the finding of the Legislature that a certain rule of the
Public Health Districts relating to Rules of Idaho Public Health District
No. 1 is not consistent with legislative intent and should be rejected.

NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular
Session of the Sixtieth Idaho Legislature, the Senate and the House of
Representatives concurring therein, that IDAPA 41.01.01, Rules of Idaho
Public Health District No. 1, Section 100, Water Quality Control,
Subsection 06.c, the last two sentences, only, a final rule, be, and the
same is hereby rejected and declared null, void and of no force and
effect."

IDAPA 41.01.01, Rules of Idaho Public Health District No. 1, Section 100,
Water Quality Control, Subsection 06.c in its entirety, courtesy of:

"c.  An application for a subsurface sewage disposal repair permit is
required for all remodeling or replacement of an existing structure served
by a sewage disposal system which fails to have both a septic permit an an
approved final inspection. The sewage disposal system must be upgraded to
current standards if possible. If this is not possible, the sewage
disposal system must be upgraded to the best possible system given the
constraints of the property. The remodeled or replacement structure will
be limited to no more than one hundred ten percent (110%) of the original
structure’s square footage of habitable space. An alternative system may
be required."

It is my understanding that, should that portion starting with "The
remodeled or replacement structure . . . " be removed, property owners
will be permitted to expand structures on their property without having to
update their septic systems, ultimately resulting in waste being dumped
into North Idaho's lakes and streams.
