Judge denies motion for reconsideration in UI retirees' lawsuit

Latah County District Court Judge John Stegner has denied a motion for
reconsideration in a lawsuit brought against the University of Idaho by a
group of retirees.

The case could be headed for the Idaho Supreme Court after Stegner’s
decision, which was filed Wednesday.

Ron Landeck, the retirees’ Moscow-based attorney, said he was disappointed
with Stegner’s ruling. He said he notified the four plaintiffs in the case
— Wileen Anderson, Harvey Neese, Joyce Presby and Arthur Smith — about the
result of the motion via e-mail.

Landeck said he is attempting to schedule a meeting with the clients to
discuss where they want to go from here.

“I believe that they are (leaning) toward making an appeal to the Idaho
Supreme Court based on some of the things I’ve heard them say publicly,”
he said. “I think they would pursue it because they believe they are in
the right, and that the Supreme Court will ultimately make that decision
in their favor.”

The plaintiffs would have 42 days from Wednesday to file a notice of
appeal, Landeck said.

The case may not be heard before the Supreme Court until as late as the
fall. It may be picked up by either the Supreme Court or the Idaho Court
of Appeals, Landeck said.

The four plaintiffs are named as representatives of the more than 260
former UI employees that took early retirement buyouts from UI in 1999 and
2001. The agreements stated the retirees would receive UI-paid medical and
life insurance that was detailed by “existing UI policy.”

The retirees’ benefits were diminished in 2007 after a UI task force
proposed the reductions to cut costs.

If the judgement was taken in front of the Supreme Court and overturned,
Landeck said the retirees would “feel as if justice had been done.”

“These are people that went into this process in good faith and do not
believe the university has demonstrated good faith,” he said. “These
promises were made, and not only is this a breach of trust, it also
affects people financially.”
