The Moscow Mayor, City Council and Staff welcome you to tonight's meeting.  We appreciate and encourage public participation.  For regular agenda items, an opportunity for public comment is sometimes provided after the staff report.  However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations may be placed on the time allowed for comments.  Citizens wishing to comment on business that is not on the agenda will be provided the opportunity to do so as item number 3.  If you plan to address the Council, you will find a list of "Tips for Addressing the Council" in the door pocket outside the City Council Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting, we may highlight good deeds, good news, and the people and activities that inspire us and make our community great, then lead the group in the Pledge of Allegiance.  Contact a Council-member with examples to share at future meetings.

 

NATIONAL BIKE MONTH, WATER SAFETY MONTH, PUBLIC SERVICE RECOGNITION WEEK AND MUNICIPAL CLERKS WEEK PROCLAMATIONS - Mayor Chaney

 

1.       Consent Agenda:  Any item will be removed from the consent agenda at the request of any member of the Council and that item will be considered separately later.  Approval by roll call vote.

 

A.     Approval of Minutes of April 19, 2010 - Stephanie Kalasz

 

B.     Approval of Quarterly Financial Report - Don Palmer

 

C.     Annual Resolution for Destruction of Documents - Stephanie Kalasz

The proposed Resolution categorizes certain Moscow records as "temporary" or "semi-permanent" pursuant to Idaho Code § 50-907.  The City Clerk and City Attorney are of the opinion that such records should not be classified as "permanent" or historical records pursuant to the current Idaho Code.  The proposed Resolution allows for the destruction of the listed items pursuant to current Idaho Code and in harmony with House Bill 48.  The reason for the proposed Resolution is to allow various departments to dispose of records to preserve space and to control their day-to-day operations in an efficient manner.  This was reviewed by the Administrative Committee on April 26, 2010.

 

ACTION:  Adopt Resolution 2010-06.

 

2.       Mayor's Appointments - Mayor Chaney

 

3.       Public Comment and Mayor's Response Period (limit 15 minutes)  - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  Mayor will respond to comments from previous meeting. 

 

4.       Citizen Commission Report - Moscow Arts Commission - Kathleen Burns

 

5.       Farmers' Market Task Force Report - Kathleen Burns

This is a final report by the Farmers Market Task Force. This report makes recommendations for improvements to the market and addresses the initial issue of "moving the market to Main Street."  This was presented to the Administrative Committee on April 26, 2010.

 

ACTION:  Accept the report and direct staff regarding Farmers' Market Task Force recommendations.

 

6.       Hubbe Appeal of Day Care License Denial - Keli Jones

On April 13, 2010, Mari Hubbe was denied a Day Care License pursuant to Moscow City Code 9-10-8(B)(14) due to a violation of Idaho Code Section 37-2732(d).  She appeals the denial to the City Council per Moscow City Code 9-10-15.

 

ACTION:  Affirm the decision made by the City Clerk's Office (with an explanation) or reverse the decision to deny (with an explanation).

 

7.       Paradise Creek Daylighting Project Flood Map Revision Participation Request - Bill Belknap

As the Council is aware, the University of Idaho and Army Corps of Engineers are in the process of conducting a restoration project on Paradise Creek within the City of Moscow.  The proposed scope of work includes channel enhancements within Reaches 1a, 1b and 3, and new channel construction within Reach 2.  The project design documents and associated hydrologic and hydraulic analysis indicate that the project will significantly reduce the width and overall size of the 100-year floodplain within the project area, possibly to less than 25% of its current size.   While the Corps of Engineers is the agency overseeing the restoration project, it is not within the project scope nor does the Corps of Engineers assume any responsibility to update the Flood Insurance Rate Maps (FIRM).  Under the NFIP program the responsibility for maintaining and updated the FIRM lies with the local jurisdiction.  The University of Idaho anticipated doing the surveying, documentation and calculations to support changes to the floodplain within Reach 2, but did not anticipate doing the same for Reaches 1a, 1b and 3. The area within Reaches 1a and 1b are especially important to the City, as the proposed improvements to Paradise Creek will remove most of the floodplain from the downtown area, including the Legacy Crossing Urban Renewal District.  The revision of the floodplain map is a significant benefit to the City and property owners.  City Staff met with the University of Idaho staff who indicated that although they did not anticipate doing the work for the revision of the floodplain map for Reaches 1a and 1b, they would be willing to extend the professional services contract with McMillien Engineering to include this additional work, but would like some financial participation from the City.  It is estimated that the additional cost for the revision of the floodplain map in Reached 1a and 1b is likely to be approximately $15,000-$20,000.  Staff recommends that the City participate in the amount of $5,000 to be paid from the Community Development Department Professional Services line item funding that had been anticipated to fund the Unified Code Project which is now being completed internally by City Staff.  Since the additional survey work needs to be coordinated with the construction staking work anticipated to begin in the next week, Staff was unable to bring this to Committee prior to Council.

 

ACTION:  Approve City financial participation within the flood map revision process in the amount of $5,000 to be funded from the Community Development Planning Consulting Services line item #101-120-10-642-40; or take other action as deemed appropriate.

 

8.       FAA Moscow-Pullman Regional Airport Grants - Gary J. Riedner

Congress has not passed the FAA reauthorization as of this date, which has caused uncertainty and delay in the FAA's Airport Improvement Program (AIP) grants.  At this point, FAA does not expect to issue grants until July or August and they believe a very short turnaround will be required for acceptance of grant offers.  In anticipation of this situation, we consulted with FAA and asked them if a pre-approval of the grant offer would expedite the process.  They responded in support of this action by both the Cities of Moscow and Pullman.  At this time we know that the maximum possible grant for 2010 project will be $1,600,000.  That amount includes our 2010 entitlement grant of $1,000,000 and $600,000 in carry-over funds from 2009.  The Airport is requesting Council action to authorize Mayor Chaney to accept one or more 2010 FAA grant offers up to a total amount of $1,600,000.  This was reviewed by the Public Works/Finance Committee on April 26, 2010.

 

ACTION:  Approve acceptance of airport grant(s) up to a total of $1,600,000 or take such other action deemed appropriate.
