The Moscow Mayor, City Council and Staff welcome you to tonight's meeting.  We appreciate and encourage public participation.  For regular agenda items, an opportunity for public comment is sometimes provided after the staff report.  However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations will be placed on the time allowed for comments.  Citizens wishing to comment on business which is not on the agenda will be provided the opportunity to do so as item number 3.  If you plan to address the Council, you will find a list of "Tips for Addressing the Council" on the table outside the City Council Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message then lead the group in the Pledge of Allegiance.  Contact a Council-member with examples to share at future meetings. 

 

1.       Consent Agenda:  Any item will be removed from the consent agenda at the request of any member of the Council and that item will be considered separately later.  Approval by roll call vote.

C.     Safe Routes to School Contract - Alisa Stone/Les MacDonald

The University of Idaho and the City of Moscow jointly applied for a SR2S grant for FY2009 funding.  The City, on behalf of the U of I, was awarded $10,000 to perform the non-infrastructure activities to include Education, Encouragement and Evaluation for schools with grades K-8 in the Moscow School District.  The City of Moscow was awarded $70,000 for the installation of 1,000 square yards of new concrete sidewalks on "B" and Garfield Streets to provide connectivity between Lena Whitmore Elementary and Moscow Junior High School.  The Engineering Department will provide design and construction management services as in-kind match for the grant award.  The City of Moscow is the fiscal agent for the grant project and therefore must execute an agreement with the Idaho Transportation Department.

 

ACTION:  Approve Contract and Resolution 2009-03.

Public Comment and Mayor's Response Period (limit 15 minutes)  - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  Mayor will respond to comments from previous meeting. 

 

4.       2008 Citizen Survey Report - Gary J. Riedner/Jennifer Pfiffner

The Administration Department administered the fourth comprehensive City of Moscow Citizen Survey in November of 2008.  The purpose of the survey was to assess the public's opinion of various aspects of City services and operations.  Additionally, questions were included by the City's citizen committees and commissions related to each of the group's charge and mission.  The surveys were mailed to 1,200 randomly selected residents.  A total of 356 completed surveys were received, which after accounting for non-deliverable surveys resulted in a 32% response rate.

 

ACTION:  Accept report.

 

5.       Proposed Ordinance to Classify Vicious Animal Violation as a Misdemeanor - Randy Fife

Currently under Moscow City Code § 10-5-14, a citation for vicious animal is an infraction pursuant to M.C.C. §10-5-16.  The violation of Idaho Code §25-2805(2) for a vicious dog results in a misdemeanor.  Because of the serious nature and potential harm caused by vicious animals, it is proposed that the City of Moscow Code regarding wild and/or vicious animals be amended to align itself with the intent of Idaho State Code.  The City Prosecutor, City Attorney's office, and Moscow Police Department are in agreement with this recommendation.

 

ACTION:  Approve Ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title and published by summary; or consider the Ordinance on first reading and that it be read by title; or reject the Ordinance; or take such other action deemed appropriate.

 

6.       Draft Ordinance to Add Appeals Procedures for Various Business Licenses - Randy Fife

A recent review of Title 9 revealed that certain business licenses issued by the City do not provide for an appeal process when they are denied, suspended, or revoked.  The City Attorney recommends that an appeal process be created for the general business license (circuses, etc.); secondhand dealers and pawnbrokers; taxicabs; and solid waste haulers, in order to meet due process and fairness requirements.  The addition of an appeals process will also help the City to create a factual, evidentiary and procedural record.

 

ACTION:  Approve Ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title and published by summary; or consider the Ordinance on first reading and that it be read by title; or reject the Ordinance; or take such other action deemed appropriate.

 

7.       Request by Waste Management, Inc. to Assign Solid Waste Export Contract to Waste Connections of Idaho, Inc. - Gary J. Riedner/Randy Fife

The City has received a request from Waste Management, Inc. to assign its right under the contract to Waste Connections of Idaho, Inc. which is the company that has been subcontracting the actual hauling of municipal solid waste from the Latah Sanitation Transfer Station to Waste Management's landfill at Arlington, Oregon.  The terms of the contract between the City of Moscow and Waste Management contains a provision which allows for assignment with the City's written consent. Staff reviewed and edited the document and recommends approval.  Reviewed by the Administrative Committee on January 12 and 26, 2009.

 

ACTION:  Approve assignment of Waste Management Solid Waste Export Contract to Waste Connections of Idaho.

 

8.       Moscow School District - License Agreement - Alisa Stone / Gary J. Riedner

After receiving approval from the City Council to submit an application to the Idaho Department of Parks and Recreation for funding to improve Paradise Path from Heron's Hideout to Carol Ryrie Brink Nature Park, staff met with Moscow School District Superintendent Dr. Candis Donicht to inform her that the City was applying for the grant and that, if awarded, we would be able to pave the existing dirt path on the north end of the Joseph Street Property parallel to Paradise Creek within the Brink Nature Park.  Dr. Donicht has offered a license agreement which would allow use of the property under certain requirements.

 

ACTION:  Approve license agreement and authorize Mayor's signature or give staff direction on how to proceed.

 

9.      Discussion of Interpretation of Catering Permit Code - Randy Fife/Stephanie Kalasz

 

ACTION:  Discuss and advise staff as deemed appropriate.
