[Vision2020] OUCH!

Note that the article says nothing about the resident being charged for the closet-op.  The officer is within his right to have a look around for his own protection but the fruit of this evidence was tainted by them not having a warrant specifically to look for a grow-op which was not in plain sight.

Many phones have been tapped illegally.  This helps in gathering information but is not admissable in court as evidence.  Same situation.  Now there is information they may value but cannot bring a charge from this particular small finding.  

Personally, this shouldn't even be a crime for as much as could be produced in a closet.  The guys were doing what they could to provide for their own medical well being while avoid engaging in a criminal black market and reducing risk by avoiding driving around.  The city could benefit greatly by allowing a permit to grow one or two plants for personal use.  Besides the revenue from the fees collected there would be a great reduction in expense spent on enforcement and prosecution of a substance less harmful than caffiene and that the public have shown they would want legalized.
