1.      Approval of Minutes September 8, 2008 - Stephanie Kalasz

 

2.      Review of Alcohol License for Café Silos - Stephanie Kalasz/Randy Fife

The Silos made application to sell beer and wine for consumption on premises September 6, 2007.  Because the Silos Restaurant was located within three hundred feet (300') of the Impact Church, the Silos also sought a waiver of the prohibition for sales of alcohol within three hundred feet (300') of a school, church, or other place of worship.  The City granted a waiver of the prohibition to the Silos pursuant to MCC § 9-6-17(B) at a Council meeting held May 21, 2007.  The Silos has been operating pursuant to that waiver since May 21, 2007.  John Houser, the pastor of the Crossing Ministries (new owners of the building housing the Impact Church) has objected to the license and requests that, prior to issuance of a beer and wine license in January of 2009, the Council reconsider its waiver.

 

ACTION:  Receive input and review materials prior to Council consideration on regular agenda or give staff direction.

 

3.      Draft Ordinance to Adjust Membership on Certain Commissions - Mayor Chaney/Randy Fife

The draft Ordinance adds to various Commissions (i.e., Parks and Recreation, Arts, Fair and Affordable Housing, Health and the Environment, Historic Preservation, Transportation, and Human Rights) the following:  at least one (1) student enrolled in at least 3/4 time in a post secondary educational program for a period of a renewable one (1) year term; at least one (1) student enrolled in high school or an equivalent educational program to serve as a non-voting ex officio member for a renewable one (1) year term; and at least one (1) Latah County resident who does not reside within City limits as a non-voting ex officio member of the Commission for a term equal to other members of the respective Commission.  It also designates a Council member as a non-voting ex officio member of the Human Rights Commission.

The purpose of this Ordinance is to bring a broader and, perhaps, different perspective to each of the foregoing Commissions, and to encourage the Mayor, City Council and Commissions to actively seek out those persons for inclusion on the Commissions who have the characteristics listed.  Additionally, the Ordinance proposes a change of name from the Commission on Health and the Environment to the Sustainable Environment Commission.

 

ACTION:  Review draft ordinance and give direction to staff.

 

4.      Use of City Facilities by Candidates for State and Federal Elected Offices - Randy Fife/Nancy Chaney

There has been recent interest in the City's practices regarding use of City Council Chambers and other City facilities which are not currently addressed by a City policy.  For example, the City has traditionally allowed incumbent elected officials to hold "town hall" meetings in Council Chambers without charge.  Issues of fairness, propriety, "politicizing" of City facilities, expenditures, access to government, and other issues suggest that a written policy might be developed.

 

ACTION:  Provide direction to staff regarding City facility use policy.

1.      Approval of Minutes September 8, 2008 - Stephanie Kalasz

 

2.      Adams Lot Line Adjustment in Trautman Addition - Mike Ray

Don and Judy Adams are requesting a lot line adjustment for a 6,706 sq ft parcel of land currently addressed as 609 Homestead Street and legally described as Lot 2 Block 2 of the Trautman Addition to the City of Moscow.  The subject parcel currently has a two-family dwelling built on the property, is in the Medium-Density Residential (R-3) Zone, and is required by the Zoning Code to be a minimum of 7,000 sq ft in size.  Mr. and Mrs. Adams are requesting to amend the southern lot line of the parcel in order to add an additional 300 sq ft of area to their property.  The incorporation of 300 sq ft of the adjacent parcel would bring the subject parcel to 7,006 sq ft in size as shown on the attached map.  The subject parcel would then be in compliance with the City of Moscow Zoning Code, rendering it legally conforming.

 

ACTION:  Recommend approval of the lot line adjustment request; recommend denial of the lot line adjustment request; or take such other action as deemed appropriate.

 

3.      UI Parking Memorandum of Understanding - Les MacDonald

On August 7, 2001 the City of Moscow and the University of Idaho entered into a memorandum of understanding that authorized the University to manage parking in specified areas on dedicated city streets within the general boundaries of the campus.  In 2002 and again in 2003 the original one year pilot program was extended an additional year.  No additional Council action regarding the term of the agreement has occurred since the last extension in 2003, but the program has continued and the University has accounted for all funds collected by the program.  The last action before the Council on the parking program was an annual report presented by former UI representative Dan Schoenberg on June 14, 2004.  The current proposed Memorandum of Understanding will update the previous agreement and provide automatic annual renewals until the agreement is terminated by either party.

 

In general terms, the agreement allows the University to establish parking permit requirements on certain City streets and to manage permit sales and enforcement revenue.  The original proposal for the parking restrictions and subsequent modifications are coordinated with the City Staff.  The new agreement also specifies that the University will convey $20,000 per year to the City from the proceeds of the permit sales and enforcement activities.  This is projected to be the annual average net revenue after expenditures generated by the program for the next five years. 

 

ACTION:  Review the draft Memorandum of Understanding for City/University Parking Program and forward to the City Council with a recommendation for approval or take other action deemed appropriate.

 

4.      PCEI Public Information and Education Contract - Tom Scallorn

Water conservation continues to be a very important and highly visible issue in the City of Moscow.  The City of Moscow wishes to continue its Community Based Public Information and Education Program (PIE) for Water Conservation.  The program will serve our customers in their homes, businesses, and the local schools and will address many of the Conservation needs of the community.  The current contract is a renewal of our PIE program that has been conducted by Palouse-Clearwater Environmental Institute (PCEI) for the past 4 years.  The current scope of work has been modified to enhance our conservation efforts with some modification.  

 

Within the previous year, PCEI has been successful in producing newsletters, maintaining a presence in the local schools, and developing a comprehensive K-12 water conservation curriculum aligned with state and district standards.  Over 700 Moscow students learned about water conservation through the program last year.  PCEI also participated in many local events by setting up displays and providing conservation information at high visibility events such as the Home and Garden Expo and the Palouse Empire Mall's Earth Month.  

 

ACTION:  Approve the contract for Professional Water Conservation Services and authorize for Council review or other action as may be deemed appropriate.

 

5.      Greensides Hill Supplemental Development Agreement - Bill Belknap

On March 5th of 2007 the City Council approved the Greensides Hill Preliminary plat for an approximately 8.39 acre property located along North Polk Street with several conditions.  One of the conditions of approval was that the developer construct a fence along the western property lines of Lots 10 through 23 of the plat.  The Council did not specify a specific date or time by which the fence would be required to be constructed.  The developer has requested that they not be required to install the fence until July 31, 2009.  

 

Staff has prepared a development agreement for the Council's consideration which would allow for the deferral of the construction of the fence until July 31, 2009 and which would limit the number of building permits that would be allowed to be issued prior to the fence installation to no more than 15 of the total of 34 lots within the plat.

 

ACTION:  Recommend approval of the Supplemental Development Agreement to the City Council; recommend denial of the Supplemental Development Agreement to the City Council; or take such other action as deemed appropriate.
