The Moscow Mayor, City Council and Staff welcome you to tonight's meeting.  We appreciate and encourage public participation.  For regular agenda items, an opportunity for public comment is sometimes provided after the staff report.  However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations will be placed on the time allowed for comments.  Citizens wishing to comment on business which is not on the agenda will be provided the opportunity to do so as item number 3.  If you plan to address the Council, you will find a list of "Tips for Addressing the Council" on the table outside the City Council Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message then lead the group in the Pledge of Allegiance.  Contact a Council-member with examples to share at future meetings.

 

1.       Consent Agenda:  Any item will be removed from the consent agenda at the request of any member of the Council and that item will be considered separately later.  Approval by roll call vote.

 

A.     Approval of Minutes of May 19, 2008 - Laurie Lewis

 

B.     Airport General Aviation Phase IV Project Grant - Robb Parish

The FAA has announced a grant opportunity for the Pullman-Moscow Regional Airport.  The request will fund improvements to the construction aviation area at the airport.  The project elements include General Aviation Reconstruction, Runway Incursion Markings, ARFF Gear, Runway Friction Meter, SWPPP Update, and Wetlands Delineation.  The tentative offering amount from FAA is $2,203,970.  The local match will be funded from passenger facility charges and a Washington State Aviation grant with no additional contributions required from the City of Moscow.  Total project costs are estimated at $2,319,968.00.  Reviewed by the Administrative Committee on May 27, 2008.

 

ACTION:  Approve acceptance of the grant offer from FAA.

 

C.     Reimbursement to North Latah Highway District - Don Palmer

Due to an error that was recently found in the software program used by Latah County, a calculation of highway tax receipt apportionment received from the State of Idaho was incorrect.  The remedy is to refund the North Latah Highway District the amount of the miscalculation.   The attached letter from Latah County outlines the cause of the error affecting the highway tax receipt apportionment calculations since 1997.  The problem resulted from the tax apportionment of the Moscow Urban Renewal Agency's (URA) Alturas Urban Renewal District project.  It should be noted that the funds were receipted to the City while they should have been distributed to the North Latah Highway District.  It is recommended by both the Highway District and Latah County that we reimburse the County and they will in turn reimburse the Highway District.  This provides a clean audit trail and corrects the mistake.  Reviewed by the Public Works/Finance Committee on May 27, 2008.

    

ACTION:  Direct staff to disburse funds to Latah County for reimbursement to the North Latah Highway District.   

 

D.     Ross Bequest - Gary J. Riedner

Dorothy Scholl Ross passed away on September 17, 2007.  She has made a very generous bequest to the Moscow Fire Department of fifty thousand dollars ($50,000) and to the Moscow Parks and Recreation Department of forty thousand dollars ($40,000) for a combined total of ninety thousand dollars ($90,000).  The City has recently received a check in the amount of ninety thousand dollars ($90,000) from the Dorothy S. Ross Estate.  Staff is requesting that City Council agree to accept this bequest of ninety thousand dollars ($90,000) as explained above.  Reviewed by the Public Works/Finance Committee on May 27, 2008.

    

ACTION:  Accept the generous bequest from the Estate of Dorothy Scholl Ross in the amount of fifty thousand dollars ($50,000) to the Moscow Fire Department and forty thousand dollars ($40,000) for the Parks and Recreation Department for a combined total of ninety thousand dollars ($90,000).

Public Comment and Mayor's Response Period (limit 15 minutes)  - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  Mayor will respond to comments from previous meeting.  

 

4.       Public Hearing - Moscow Urban Renewal Agency Proposed Legacy Crossing Urban Renewal Plan - Gary J. Riedner

The Moscow Urban Renewal Agency presents for consideration and approval the Legacy Crossing Urban Renewal District Plan (Attachment 1).  The Moscow City Council and Mayor approved Resolution 95-08 & 95-13, finding the City of Moscow to be a competitively disadvantaged border community consisting of deteriorated and deteriorating areas within the City and thus created and empowered the creation of the Moscow Urban Renewal Agency.  The Agency has since brought forth and gained approval from the Council and Mayor for previous projects area plans, Alturas Phase I and Alturas Phase II.  In addition, the Legislature of the State of Idaho enacted the Local Economic Development Act, authorizing urban renewal agencies to adopt revenue allocation financing provisions as part of their urban renewal plans, if the area is considered to be a deteriorated or deteriorating area.  Based on findings of Harlan W. Mann, Consultant as outlined in an eligibility report an area was identified that meets these criteria and was named the Legacy Crossing Urban Renewal District.  Those findings were approved by the Mayor and City Council through Resolution 2007-24 (Attachment 2).  A plan for redevelopment was crafted and approved by the Moscow Urban Renewal Agency on March 6, 2008 and in accordance with Idaho Code, was approved by the Moscow Planning and Zoning Commission on April 29, 2008 as complying with the City's Comprehensive Plan (Attachment 3).  As required by Idaho Code § 50-2905 and § 50-2906 notice of the June 2, 2008 public hearing was published on May 2, 2008 and the Plan details were made available to the general public and all taxing districts (Attachment 4).  

The Legacy Crossing Plan proposes that the Moscow Urban Renewal Agency, and the Mayor and City Council, desire to eliminate conditions impeding the City's economic growth in an area designated as the Legacy Crossing Urban Renewal District.  The Agency will pro-actively address issues creating static economic conditions for the last decade or more, by taking actions targeted toward improvement of both underdeveloped properties and those properties in transition.  Such actions are intended to facilitate transition of properties from former agricultural and/or industrial uses to new uses, to create more cohesive zoning arrangements, to add to the General Business and Residential/Office mixed uses zones, and thereby transform the area from its current economic state toward economic vibrancy.  This transition will add to the quality of civic life and improve the public safety of citizens and visitors.

 

ACTION:  After public hearing, approve the Legacy Crossing Urban Renewal District Plan and pass the Ordinance under suspension of the rules requiring three complete and separate readings and that the Ordinance be read by title only or take such other action deemed appropriate.

 

5.       Public Hearing - Indian Hills 8th Addition Rezone and Preliminary Plat - Bill Belknap

On March 14th of this year the Community Development Department received an application for a Rezone and Preliminary Plat for an approximately 23 acre parcel of land generally located east of Highway 95, north of East Palouse River Drive, and south of Indian Hills Drive known as the Indian Hills 8th Addition.  The applicant proposes to rezone the subject property from a combination of Motor Business (MB) and Farm Ranch and Outdoor Recreation (FR) to Multiple Family Residential (R4) and to subdivide the property into three lots ranging from 1.6 to 14.1 acres in size. The Planning and Zoning Commission conducted a public hearing on the matter on April 23rd, 2008 and recommended approval of the application with the conditions reflected in the attached Reasoned Statement of Relevant Criteria and Standards.  The matter is now before the City Council for the Council's consideration.

 

ACTION:   

1.  Approve the Rezone Ordinance under suspension of the rules requiring three complete and separate readings and that it be read and published by title only; or consider the Ordinance on first reading; or reject the Ordinance; or take such other action deemed appropriate;

 

2.   If the Ordinance is approved, approve the proposed preliminary subdivision plat with or without conditions; deny the preliminary subdivision plat; or take such other action deemed appropriate.

 

6.       Rendezvous in the Park 2008 Alcohol Permit Request - Dwight Curtis

In accordance with Moscow City Code 5-13-4(B), Rendezvous in the Park has requested that the Council pass a Resolution allowing them to have a beer garden catered by a licensed vendor in East City Park for Rendezvous in the Park on July 17, 18, and 19, 2008, from 5:00 p.m. to 10:00 p.m.  There will be food vendors, live music, and other activities at the event.  The licensed vendors will sell alcohol to adults with proof of age in one designated, roped off area.  One Moscow Police officer will be on site and will be paid for by Rendezvous in the Park.  There have been no problems associated with alcohol at this event in the past.  Reviewed by the Administrative Committee on May 27, 2008.

 

ACTION:  Approve the Resolution; or reject the Resolution; or take such other action deemed appropriate.

 

7.       Downtown Multimodal Parking Work Plan - Les MacDonald

As a culmination of their efforts in assessing the Downtown Parking situation, the Transportation Commission developed a series of recommendations for consideration by the City Council.  As discussed during the Transportation Commission presentation to the City Council on this matter, a work plan is being developed to address the tasks necessary to implement the Commission recommendations and whether these tasks are best undertaken by Staff and/or a new Advisory Committee.  A copy of the Transportation Commission report is attached for reference together with a draft of the Downtown Parking Work Plan.  Reviewed by the Public Works/Finance Committee on May 12, 2008.

 

ACTION:  Discuss the draft Downtown Parking Working Plan and provide direction to staff regarding implementation of work plan:

 

1.   Assess if the Council would like to determine which recommendations should be pursued and, if so, identify them for further action, OR

 

2.   Determine that the Council would like further briefings and additional information on the individual recommendations so that the Council can select which recommendations to pursue at a later date.

 

8.       Liquor Sales on Election Days - Randy Fife

Effective July 1, 2008, the State will allow sales of liquor during the time when polls are open for general and primary elections.  Because the City has endeavored to follow the State's lead in matters which regulate the sales of liquor, it is proposed that the City change its ordinance to comport with the State's change.

 

ACTION:  Approve the Ordinance under suspension of the rules requiring three (3) complete and separate readings and that it be read and published by title only; or consider the Ordinance on first reading and that it be read by title only; or reject the Ordinance; or take such other action deemed appropriate.
