REGULAR MEETING

The Moscow Mayor, City Council and Staff welcome you to tonight's
meeting.  We appreciate and encourage public participation.  For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report.  However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments.  Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 3.  If you plan to address the Council, you will find a list of
"Tips for Addressing the Council" on the table outside the City Council
Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting one City Council member will
present an example of patriotism, humanitarianism, community spirit, or
other inspirational message then lead the group in the Pledge of
Allegiance.  Contact a Council-member with examples to share at future
meetings.

 

Proclamation for Parks and Recreation Month - Nancy Chaney

 

1.       Consent Agenda:  Any item will be removed from the consent
agenda at the request of any member of the Council and that item will be
considered separately later.  Approval by roll call vote.

 

A.     Approval of Minutes of June 16, 2008 - Stephanie Kalasz

 

B.     St. Augustine's Right-of-Way Deed of Dedication Acceptance - Les
MacDonald

The Roman Catholic Diocese of Boise, on behalf of St Augustine's Church,
is dedicating a three hundred and forty (340) square foot parcel of
their property on the east side of Deakin Street, near the north west
corner of their property to allow the City to construct and maintain a
bus shelter. The shelter will be constructed this summer under a project
jointly funded by the City and the Federal Transit Authority's 5309
grants.  Such dedications must be recognized and accepted by the City.
Reviewed by the Public Works/Finance Committee on June 23, 2008.

 

ACTION:  Approve Right-of-Way Deed of Dedication acceptance.

 

C.     Heart of the Arts, Inc. Naming Policy as Part of Fundraising -
Dwight Curtis/Jenny Sheneman

As part of its fund raising efforts to develop the remainder of the 1912
Center, Heart of the Arts, Inc. (HAI) is planning to offer room and
amenity naming opportunities for various size financial donations to the
project. The proposed policy is intended to govern the procedure for
naming rooms, public spaces and permanent art installations in the 1912
Center.  Reviewed by the Administrative Committee on June 23, 2008.

 

ACTION:  Approve HAI Donor Recognition and Naming Policy.

 

D.     Windfall Hills Development Agreement - Les MacDonald

Mike Hoffman (as Windfall Hills L.L.C.) has submitted to the City a
final plat for the development of his property on Mountain View Road.
The City Council has approved a preliminary plat for this property.  The
final plat is titled the Windfall Hills Addition to the City of Moscow
and may include several phases of development.  In order for the
developer to move forward with the implementation of the project, a
development agreement is needed to address construction of public
improvements, phasing of such construction, parkland dedication, street
tree contributions, and as-constructed drawings.  The attached Agreement
covers these items and references the Memorandum of Understanding (MOU)
between the City, Mike Hoffman, and Mark Wintz, which addresses
completion of the bicycle/pedestrian pathway, the extension of Janson
Street and the relocation of a Verizon fiber optic pedestal.  The
Development Agreement specifies that the public improvements for each
phase of the Windfall Hills Addition will be constructed within nine
months of the issuance of the first building permit within that phase.
This time frame will allow for winter construction of structures with
completion of public works improvements during the summer months.
Reviewed by the Public Works/Finance Committee on June 9, 2008.

 

ACTION:  Approve the Development Agreement.

 

E.      Windfall Hills Monumentation Agreement - Les MacDonald

Mike Hoffman (as Windfall Hills L.L.C.) is the owner and developer of
the proposed Windfall Hills Subdivision on Mountain View Road.  The
interior property corners will not be set until after the final plat has
been filed, the earthwork has been completed, and the utilities have
been installed. In such instances, an agreement obligating the
establishment of these interior corners is required by Idaho Code.   The
final plat and the Development Agreement for public improvements are
expected to be concurrently approved by Council.  Reviewed by the
Administrative Committee on June 9, 2008.

 

ACTION:  Approve the Monumentation Agreement.

3.       Public Comment and Mayor's Response Period (limit 15 minutes)
- For members of the Public to speak to the Council regarding matters
NOT on the Agenda and not currently pending before the Planning and
Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes.  Mayor will
respond to comments from previous meeting.  

 

4.       Public Hearing - Folkestone Preliminary Plat - Bill Belknap

On April 15th, 2008, the Community Development Department received an
application for a Planned Unit Development (PUD) and Preliminary
Subdivision Plat from Robyn and Mark Picca for property currently
addressed as 2415 White Avenue and legally described as Lot 1 of Block 9
of the Southgate Second Addition to the City of Moscow.  The subject
property is currently Zoned Multiple Family Residential (R4).  The
proposed Preliminary Plat would subdivide the approximately 1.04 acre
lot into eight lots that are proposed to be developed with detached
single family dwellings.  The resulting lots would range from 5,000 to
7,150 square feet in size and would meet all applicable standards with
the exception of public street frontage.  Four of the eight lots would
not have frontage on a public street, but instead would gain access to
White Avenue via dedicated access easements and two shared driveways.
The Planning and Zoning Commission conducted a public hearing upon the
Preliminary Plat and PUD applications on May 28th at which time they
recommended approval of the preliminary plat with the condition that all
utility routing and services be approved by the City Engineer and that
utility service easements be provided between lots for all private
utility services.  

 

      ACTION:  After listening to public testimony, approve the
preliminary plat with or without conditions; or reject the preliminary
plat; or take such other action deemed appropriate.

 

5.       WWTP Phase IV Bid Award - Les MacDonald

One of the final major steps in implementing the WWTP phosphorous
removal improvements necessary for compliance with the City of Moscow's
NPDES permit for the facility is the execution of a construction
contract. The final design and the preparation of the construction
documents were completed by our design consulting team in May of this
year.  The Idaho Department of Environmental Quality approved the design
in early June and the project was advertised for bidding.  The bid
submission period for this project closed at 2:00 p.m. on June 25, 2008.
Two bids were received for the project.  A copy of the bid tabulation is
attached for reference.  The apparent low bidder on the base bid portion
of the project was Williams Brother Construction LLC with a bid amount
of $5,852,500.  The Public Works, Administrative, and Legal Departments
are reviewing both bids received for this project.  

 

ACTION:  Receive the report from Staff on the WWTP Phase IV Improvements
bid opening and receive recommendation from Staff; accept or reject
bids; or take such other action deemed appropriate.

 

6.       Windfall Hills Final Plat - Bill Belknap

On August 1st, 2005 the City Council issued conditional approval of the
Windfall Hills final plat.  The application was delayed due to the
necessity for an agreement to be reached between the two property owners
who were the original applicants for the preliminary plat.  This
agreement has now been reached and the property owner has brought forth
the final plat for consideration and approval. Staff has reviewed the
final plat for conformance with the Council's conditions of approval and
finds that those conditions have been satisfied.  The Planning and
Zoning Commission reviewed the final plat on July 25th, 2007 and
recommended approval of the final plat to the City Council with two
conditions.  

 

      ACTION:  Approve the final plat with or without conditions; or
reject the final plat; or take such other action deemed appropriate.
