The Moscow Mayor, City Council and Staff welcome you to tonight's
meeting.  We appreciate and encourage public participation.  For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report.  However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments.  Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 2.  If you plan to address the Council, you will find a list of
"Tips for Addressing the Council" on the table outside the City Council
Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting, one City Council member will
present an example of patriotism, humanitarianism, community spirit, or
other inspirational message.  Contact a Council-member with examples to
share at future meetings.

2.       Public Comment and Mayor's Response Period (limit 15 minutes)
- For members of the Public to speak to the Council regarding matters
NOT on the Agenda and not currently pending before the Planning and
Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes.  Mayor will
respond to comments from previous meeting.

 

3.       Public Hearing Regarding Judicial Confirmation for the WWTP -
Gary J. Riedner / Les MacDonald / Don Palmer 

The City Public Works Department has worked for the past several years
on the design and construction of Phase 4 of the City of Moscow Waster
Treatment Plant. This Phase 4 is designed to reduce phosphorus levels in
the effluent in order to comply with the City's National Pollutant
Discharge Elimination System (NPDES) permit issued by the Environmental
Protection Agency (EPA) and complies with the requirements of the State
of Idaho Department of Environmental Quality (DEQ).   Previous City
Council presentations have been made relating to the approval of the
design and the authorization to proceed. Because of the necessity of
meeting compliance requirements, it is necessary to begin the financing
process at this time.  In order to obtain financing for the Phase 4
project, Article VIII, Section III of the Idaho Constitution requires
that any obligation which extends beyond a single budget year must be
either pursuant to voter approval or be determined to be an "ordinary
and necessary expense". A public hearing is required to be held prior to
proceeding to Idaho District Court for a determination that the Phase 4
improvements are "ordinary and necessary".  This process is the same
process followed by the City in obtaining authorization for issuance of
revenue bonds to finance the Phase 3 improvements to the wastewater
treatment plant several years ago.  Per Title 7, Chapter 13 of the Idaho
Code, the public hearing must be held at least 14 days prior to adoption
of the Resolution.  The Resolution will be considered for adoption at
the May 7, 2007 meeting.

 

      ACTION:  Review and consider public testimony in regard to the
Judicial Confirmation Resolution.

 

4.       Presentation of the Fiscal Year-end 2006 Audit - Don Palmer

The accompanying Comprehensive Annual Financial Report, CAFR, for fiscal
year ending September 30, 2006 is submitted for City Council's review.
Staff will be presenting the CAFR and reporting significant changes to
City Council regarding the City's Annual Audit and outlining comparative
changes to this report from last year's report.   This report is the
City's third CAFR award, again a significant accomplishment for the
City.   We will continue to provide information that is available in one
comprehensive document.

 

      ACTION:  Accept the City of Moscow Audited Comprehensive Annual
Financial Report for fiscal year ended September 30, 2006.

 

5.       Request to add Parks and Recreation Master Plan Option to Scope
of Work for Comprehensive Plan Contract with Kendig-Keast

An option available to the City as part of the upcoming Comprehensive
Plan project, is adding a component to complete an independent parks and
recreation master plan. The additional cost for this scope of work is
$8,220. Staff is requesting adding this scope of work to the
Comprehensive Plan contract with Kendig-Keast. Funding ($8,220) would
come from Professional Services, 120-160-30-642-10, where park planning
funding has been allocated for FY07. $15,000 is presently budgeted for
park planning for Ball fields and Lola Clyde Park.  Details of the scope
of work to be added to the Kendig-Keast contract are included in the
attached memorandum.  On April 9, 2007, the Administrative Committee
directed this item to be forwarded to the City Council without a
recommendation [minutes not yet available].

 

      ACTION:  Approve adding the development of an independent Parks
and Recreation Master Plan to the Kendig-Keast Comprehensive Plan
contract; or take such other action as deemed necessary.

 

6.       Parks and Recreation Background Checks Proposal - Dwight Curtis

Staff was directed to investigate background check options for those
volunteers and staff which work with youth through the parks and
recreation programs. In summary, the recommended background checks
program has been planned and is ready to implement upon Council
approval. This program is recommended for approval by staff and the
parks and recreation commission. The City Council directed staff to
draft a resolution for their consideration. (Proposed resolution is
attached.)  Funding: The cost to implement the program is approximately
$4,000 annually or $3.50 per check per person. Backgroundchecks.com will
be providing the background check services and the Parks and Recreation
Department will administer the program. After reviewing the present
Parks and Recreation Department budget to possibly absorb the start-up
costs, staff has determined that the funds are not there. Staff is
requesting the funds be taken from the Council's Legislative Reserve
line item for this first year.  The FY08 budget will reflect this
program's cost through contractual services and recovered costs will be
reflected through youth recreational program fees and aquatics programs.

 

      ACTION:  Approve the Resolution; or reject the Resolution; or take
such other action deemed appropriate.  Approve funding from the
Legislative Reserve for FY 07 or take such other action deemed
appropriate.

 

7.       Recommendation for Historic District Logo Selection - Anne
Clapperton

As Council is aware, the Moscow Historic Preservation Commission has
sponsored and solicited entries for a competition to develop logos for
the two existing historic districts in Moscow (Moscow Downtown and Fort
Russell Neighborhood).  The Historic District Logo Competition was
opened on March 16, 2007 and closed Monday, April 2.  Five entries were
received, reviewed and narrowed to three entries by the selection
committee.  The three finalists' entries were displayed at City Hall for
a week to gain public input on the submissions; 24 comments were
received.  The selection committee met on Tuesday, April 10 to select an
entry to recommend for adoption by City Council as the official logos
for the Downtown Moscow Historic District and the Fort Russell
Neighborhood Historic District.  After much discussion and heavy
consideration of all the finalists' entries, the unanimously selected
entry was that which was designed by Melissa Rockwood of Rdesign.

 

ACTION:  Adopt logo designs by designer Melissa Rockwood for the Moscow
Downtown and Fort Russell Neighborhood Historic Districts or take such
other action deemed appropriate.

 

8.       Discussion of Possible Settlement with EPA Region 10 - Randy
Fife

The U.S. Environmental Protection Agency has informed the City of
numerous violations of the City's National Pollutant Discharge
Elimination System (NPDES) permit between March 2002 and June 2006 which
could result in a maximum fine of approximately $2.5 million.  The EPA
and City of Moscow have been discussing a potential settlement of the
matter.  It is proposed that the City enter into a Consent Agreement and
Final Order (CAFO) with the EPA and that the Mayor be authorized to sign
appropriate documents, should a resolution be reached.

 

      ACTION:  Authorize the Mayor to sign a negotiated CAFO or take
such other action as deemed appropriate.

 

9.       Adoption of 2007 City Council Goals - Gary J. Riedner

On April 9, 2007, Acting Council President Bill Lambert convened the
City Council for the annual goal-setting workshop. The goals discussed
by the Council are contained in the attached Memo.

 

      ACTION:  Formally adopt 2007 goals or take such other action
deemed appropriate.

 

10.   Set Date for Budget Hearing - Gary J. Riedner / Don Palmer

The proposed budget calendar has a date of August 6, 2007 set for the
City budget hearing.  The City must notify the County no later than
April 30, 2007 with the date for the budget hearing.

 

      ACTION:  Approve August 6, 2007 as the date for the public hearing
on the FY2008-09 budget.
