MOSCOW CITY COUNCIL
REGULAR MEETING

The Moscow Mayor, City Council and Staff welcome you to tonight's
meeting. We appreciate and encourage public participation. For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report. However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments. Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 2. If you plan to address the Council, you will find a list of
"Tips for Addressing the Council" on the table outside the City Council
Chambers. Thank you for your interest in City government.
RENEWING OUR FOCUS - At each meeting, one City Council member will
present an example of patriotism, humanitarianism, community spirit, or
other inspirational message. Contact a Council-member with examples to
share at future meetings.
Proclamation for International Walk to School Day
1. Consent Agenda: Any item will be removed from the consent
agenda at the request of any member of the Council and that item will be
considered separately later. Approval by roll call vote.
A. Approval of Minutes of September 18, 2006 - Stephanie Kalasz
B. 'A' Street Geotechnical Services Contract - Dave Klatt
Staff has been negotiating a scope of work and cost for services with
STRATA to perform the materials investigations and reports on the "A"
Street project. They will be working in conjunction with our design
consultant, Welch-Comer Engineer's. The "A" Street project design and
construction is supported by federal funding and is scheduled for 2008
construction. The project limits are to begin east of Peterson Drive and
extend to Home Street, including Line Street. This item was reviewed by
Public works Committee on September 25, 2006.
ACTION: Approve geotechnical services contract with Strata.
C. Receipt of Planning and Zoning Commission Recommendation on
Zoning Code Sidewalk Amendment - Joel Plaskon
On August 23, 2006 the Planning & Zoning Commission recommended approval
of an ordinance to amend the Zoning Code to require certain types of new
developments to include private sidewalks connecting building entrances
to public sidewalks. The Local Land Use Planning Act requires that the
Council "receive" the Commission recommendation prior to publication of
the Council hearing notice. Staff proposes November 6, 2006 Council
hearing on this matter.
ACTION: Receive recommendation.
D. Receipt of Planning & Zoning Commission Recommendation on Zoning
Code Amendment for Garage Setbacks - Joel Plaskon
On August 23, 2006 the Planning & Zoning Commission recommended approval
of an ordinance to amend the Zoning Code to increase minimum garage
setbacks in certain zoning districts in order to aide in prevention of
cars parking on sidewalks. The Local Land Use Planning Act requires
that the Council "receive" the Commission recommendation prior to
publication of the Council hearing notice. Staff proposes November 6,
2006 Council hearing on this matter.
ACTION: Receive recommendation.
E. Receipt of Planning and Zoning Commission Recommendation on
Zoning Code R-3 Single Family Dwellings and Duplexes Per Lot Amendment -
Joel Plaskon
On August 23, 2006 the Planning & Zoning Commission recommended approval
of an ordinance to amend the Zoning Code to specify, like other zones,
that only one single family residential or duplex dwelling be allowed
per lot. The Local Land Use Planning Act requires that the Council
"receive" the Commission recommendation prior to publication of the
Council hearing notice. Staff proposes November 6, 2006 Council hearing
on this matter.
ACTION: Receive recommendation.
2. Public Comment and Mayor's Response Period (limit 15 minutes)
- For members of the Public to speak to the Council regarding matters
NOT on the Agenda and not currently pending before the Planning and
Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes. Mayor will
respond to comments from previous meeting.
3. Public Hearing - Leach Preliminary Plat in the Area of City
Impact - Andrew Ackerman
On August 22, 2006, the County forwarded to the City an application to
plat an approximately 4.00 acre parcel within the Area of City Impact
into three single family lots. The subject property is owned by David &
Ann Leach and currently has one single family residence on the property
addressed as 2421 Old Pullman Road, due south of Stadium Way Trailer
Park. The subject parcel is currently zoned low density, single-family
residential (R-1). The current land use, other than residential, is
vacant grassland surrounded on three sides by cropland. The Moscow
Comprehensive Plan designates all of the land in this area as Low
Density Residential (LR). As described in the application, the subject
plat will allow for two additional residential lots to exist with
frontage (access) off of Old Pullman Hwy. As a result of the potential
increased use, and likelihood that the City will take over maintenance
along this segment of county road, the Engineering staff has recommended
that the applicants dedicate 10' of ROW to the City for future
improvements.
ACTION: Recommend approval of the preliminary plat; or recommend
denial; or take such other action deemed appropriate to be forwarded to
the County Commissioners.
4. Beebe Silos Rezone - Andrew Ackerman
On July 26th, 2006 the Planning & Zoning Commission recommended approval
of the request to rezone two properties at 625 S. Jackson & 803 S. Main
St from Industrial (I) to Central Business (CB) Zoning District. Public
Works/Finance Committee received the Planning & Zoning recommendation on
August 28th, 2006. The Council public hearing was held on September 18,
2006 and elected to table the issue until the October 2, 2006 meeting.
The public hearing was closed so no new input will be taken.
ACTION: Approve Ordinance under suspension of the rules requiring three
complete and separate readings and that it be read and published by
title only; or consider the Ordinance on first reading; or reject the
Ordinance; or take such other action deemed appropriate.
5. Request to Assist Latah Health Services Therapy Pool - Gary J.
Riedner
This item is being presented for Council discussion. A requests for
assistance for the Latah Therapy Pool have been received and range from
taking over management of the facility, providing part-time lifeguards
and/or providing funding.
ACTION: Direct staff as deemed appropriate.
