1.      Approval of Minutes November 13, 2006 - Stephanie Kalasz

 

2.      Carroll Lot Line Adjustment - Andrew Ackerman

Brent and Yvonne Carroll own a lot at 352 Dolly Drive and have agreed
with the neighboring lot owner at 356 Dolly Drive, Greg Smith, to
purchase 20 feet of the eastern portion of the lot. The adjustment would
increase the Carroll lot by 2,100 sq. ft. and reduce the Smith lot by
the same amount. The reconfiguration of the two lots would not result in
any non-conformities with the Zoning Code or the Subdivision Code.

 

      ACTION:  Recommend approval and scheduling as December 4, 2006
Council consent agenda item or take other action deemed appropriate.

1.      Approval of Minutes October 23, 2006 - Stephanie Kalasz

 

2.      Annexation Policy Amendment - Joel Plaskon

Resolution 2001-15 establishes the City annexation policy.  It does not
address the matter of zoning of lands proposed for annexation.  However,
the Farm, Ranch and Outdoor Recreation (FR) Zoning District described in
the Zoning Code specifies an intent that newly annexed lands be zoned
FR.  The location of such stated intention can been problematic and
confusing, as one looks to the annexation policy for guidance about
annexation and related issues, not to the Zoning Code.  Annexations may
have occurred without due consideration of the FR Zoning District
application, where annexation occurs without a simultaneous proposal for
rezoning.  Therefore, staff is proposing to amend the annexation policy
to explicitly include consideration of applying FR zoning at the time of
annexation.  This would simply be a cross reference to help ensure
proper consideration of FR Zoning District assignment upon annexation.
This matter was last reviewed by Administrative Committee on November
13, 2006.  Since that time, staff has verified that the Idaho Code
requirement that zoning cannot be changed for four years after a rezone
does not apply to initial zoning assignment of zoning with annexation
and only applies upon quasi-judicial application from a rezone request
by a land owner.  Staff does not believe that this proposed amendment
could lend itself to the possibility  of a land owner using the FR
Zoning District assignment upon annexation as a method of manipulation
toward controversial or undesirable zoning and development at a later
time, as suggested during the November 13, 2006 Administrative Committee
meeting.

 

ACTION:  Recommend approval of Resolution; recommend denial of
Resolution or take such other action deemed appropriate.

 

3.      Ordinance Regarding Bicycle Advisory Committee - Randy Fife

The Bicycle Advisory Commission has operated for a number of years
promoting safe and convenient bicycle use.  It has been associated since
1998 with the Transportation Commission (which is charged with
recommending policies and programs to support transportation goals and
objectives of the Comprehensive Plan).  The multi-modal objectives of
the Transportation Commission address bicycle-pedestrian uses as well.
Staff recommends that the BAC be consolidated into the Transportation
Commission.  The proposed Ordinance will terminate the Moscow Bicycle
Advisory Commission.  Additionally, to increase the number of Commission
members to a total of nine (9) because of the increased workload of the
Transportation Commission.

 

ACTION:  Recommend approval of the Ordinance; recommend denial of the
Ordinance; or take such other action deemed appropriate.

 

4.      Zoning Code Amendment - Limit R-3 to 1 SFD or Duplex per Lot -
Joel Plaskon

There currently exists an inconsistency in the Zoning Code wherein no
more than one single family dwelling is allowed per lot in the R-1 and
R-2 Zoning Districts, but the R-3 Zoning District does not specify that
only one single family or duplex dwelling is allowed per lot.  Staff is
unaware as to whether this is intentional or if it is to be assumed that
the one building per lot limitation exists in the R-3 Zoning District.
However developers have been expressing interest in constructing
multiple duplexes on single, oversized lots in the R-3 Zoning District.
It is often the case that R-3 abuts R-1 or R-2 Zoning.  Additionally, it
is not uncommon for existing R-3 neighborhoods to contain a significant
or predominant amount of single family development.  Construction of
multiple duplexes on single lots can, especially where there are shared
parking arrangements resulting in parking lots, have a multi-family
development effect in these existing single family and duplex
neighborhoods.  The proposed one dwelling or duplex per lot
specification would create consistency in zoning districts and reduce
possibility of unintended impacts on R-1, R-2 and R-3 neighborhoods.
The Planning and Zoning Commission conducted a public hearing and
recommended approval of this code amendment on August 23, 2006.  The
Mayor and City Council conducted a public hearing on the matter and
passed a first reading of the ordinance on November 6, 2006 with some
dissent regarding how to interpret the existing code and the need or
benefit of the proposal vs. the impact to property owners.  The
Administrative Committee reviewed the matter again on November 13, 2006
and requested additional information about impact to housing
opportunities and additional photos.  

 

ACTION:  Recommend approval or rejection of proposed Ordinance or
recommend substantial amendments and return to Planning and Zoning
Commission for new initial hearing.
