Tony,

I think that the question of whether flag burning is or is not speech is not so clear. Luckily it is mute point, for speech is not the only form of freedom that our constitution protects.

Second, the law should only be used for clear harms to clear persons. Does burning a flag cause physical harm to anyone? No. Lots of folks don't like it but if there were laws against everything I didn’t like, then bad reasoning like yours would be prohibited and we wouldn’t be having this discussion. (Sorry, I couldn't resist the joke!)

behavior speaks for itself. Irrelevant apples and oranges comparisons 
notwithstanding.
