3. Meadow Brook 2nd Addition Final Plat Final Plat - Andrew Ackerman
On September 6, 2005, the Council approved a preliminary plat and partial re-plat of the 7.6 acre Meadow Brook 2nd Addition. Approval was conditioned upon vacation of the northern portion of the platted Meadow Street right-of-way. The vacation was approved by Council at the September 6, 2005 meeting. Additional minor conditions recommended by Staff and the Planning & Zoning Commission have been met by the applicant, however the applicant will be required to enter into a formal development agreement for public improvements prior to signature of the final plat.
ACTION: Recommend approval of final plat; or recommend denial of the final plat; or take such other action deemed appropriate.
4. Four-way Stop at D Street and Mountain View - Dave Klatt
There has been interest expressed to staff that suggests the need for a multi-way stop condition at the "D" and Mountain View Road intersection. An in-house traffic study looked at vehicular volumes, accidents, turning movements and level of service at this location to determine if this action is warranted. This item was originally presented to the Public Works Committee in May 2006 as a report.
ACTION: Recommend the creation of a school zone on Mountain View Road similar to that on "D" Street at the Jr. High School where vehicles would be required to slow to 20 mph when children are present; or take such other action deemed appropriate.

1. Approval of Minutes of July 24, 2006 - Stephanie Kalasz
2. Tower Agreement for Fire Department Repeater - Don Strong
This agreement between Bennett Lumber Products, Inc. and the City of Moscow is for maintenance and operation of a radio transmitter-receiving station on a Bennett Lumber Products tower. This agreement includes an annual rental fee and their portion of yearly electrical charges.
ACTION: Recommend approval of the agreement; or recommend denial of the agreement; or take such other action deemed appropriate.
3. Land Use Application Processes - Joel Plaskon
Historically, the City processed discretionary land use applications involving multi-faceted applications (e.g. Comprehensive Plan amendment and rezone, rezone and preliminary plat, preliminary plat and P.U.D., rezone and S.U.P., etc.) concurrently. Typically, one hearing would be conducted covering all of the land use application elements of the project, and the hearing body would then deliberate on all discretionary aspects of the proposal and render separate decisions, in the necessary order, on each part of the proposal. Recently, each application has been heard separately, in the necessary order, on different dates and submittal of one element of the application without the prior step having been completely approved has not been allowed. The Mayor, Council, Planning and Zoning Commission and the public have indicated a desire to have a public discussion to consider the positive and negative consequences of how these applications are processed and the possibility of "merging" applications to be heard concurrently.
ACTION: Direct staff as deemed appropriate.
4. Sidewalk Café Ordinance - Stephanie Kalasz/Randy Fife
In order to make Sidewalk Café Licenses consistent with Peddler/Solicitor, Vendor and similar types of licenses, staff is proposing this Ordinance to be included in Moscow City Code, Title 9, Chapter 12.
ACTION: Recommend approval of the Ordinance; or recommend denial of the Ordinance; or take such other action deemed appropriate.
5. Retention of Preston, Gates & Ellis LLC as Bond Council for WWTP Judicial Confirmation - Gary J. Riedner
The City of Moscow is proceeding with the design and financing of the next phase (effluent filter for phosphorus removal) of the Wastewater Plant in order to bring it into compliance with current (and anticipated) EPA and DEQ regulations. As part of the financing, the City wishes to engage the firm of Preston, Gates and Ellis for assistance in judicial validation of the City's project, financing of the project, and management of legal issues related to the Wastewater Treatment Plant upgrade. It is the opinion of staff that the contract attached hereto is reasonable for the types of legal services necessary to develop the Wastewater Treatment Plant upgrade.
ACTION: Recommend approval of the Special Services Contract and/or suggest changes in the contract and give further instruction.
