The Moscow Mayor, City Council and Staff welcome you to tonight's
meeting. We appreciate and encourage public participation. For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report. However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments. Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 3. If you plan to address the Council, you will find a list of
"Tips for Addressing the Council" on the table outside the City Council
Chambers. Thank you for your interest in City government.
RENEWING OUR FOCUS - At each meeting, one City Council member will
present an example of patriotism, humanitarianism, community spirit, or
other inspirational message. Contact a Council-member with examples to
share at future meetings.
1. Consent Agenda: Any item will be removed from the consent
agenda at the request of any member of the Council and that item will be
considered separately later. Approval by roll call vote.
A. Approval of Minutes of July 17, 2006 - Stephanie Kalasz
B. Mutual Aid Agreement with Neighboring Communities - Don Strong
This is an updated mutual aid agreement with fire departments that
surround Moscow. It allows all surrounding entities to be on one mutual
aid agreement and to keep it current. The mutual aid is for fire and
hazmat and specifies parameters of aid, command and allocation of cost.
The agreements are based on the ability of the requested department to
respond and do not obligate a response. This is the first mutual aid
agreement for some of the neighboring Washington districts and
departments being included on the agreement as well. This Agreement
assists the Department in improving fire ratings and obtaining grants.
Reviewed by the Administrative Committee on July 10 and 24, 2006.
ACTION: Approve Mutual Aid Agreement.
C. Indian Hills Lot Division - Andrew Ackerman
The subject property is located at the southeast end of Indian Hills
Drive and is approximately .70 acre The applicant is requesting that
three additional lots, approximately 10,000 sq. ft. each, be created.
The proposed new lot dimensions meet all the minimum requirements for
lot dimensions and street frontage in the Low Density Single-Family
Residential (R-1) Zoning District. Reviewed by the Public Works/Finance
Department on July 24, 2006.
ACTION: Approve lot division.
D. Receipt of Planning and Zoning Commission Recommendation for A
Street and Farm Road Rezone - Andrew Ackerman
On July 26, 2006, the Planning & Zoning Commission recommended approval
of a rezone for approximately 2.45 acres of land on the southwest corner
of the intersection of "A" Street and Farm Road from the Farm, Ranch,
and Outdoor Recreation (FR) Zoning District to the Motor Business (MB)
Zoning District. The Local Land Use Planning Act requires that the
Council "receive" the Commission's recommendation prior to publication
of the Council hearing notice. Staff Desires a September 5, 2006
Council hearing on this matter, as per the attached draft hearing
notice.
ACTION: Receive recommendation.
E. Contract with Archaeological and Historical Services - Les
MacDonald
Staff has been negotiating a scope of work and cost for services with
Archaeological & Historical Services (AHS) to perform the cultural
investigation on the "A" Street project. They will be working in
conjunction with Welch-Comer Engineer's. The "A" Street project design
and construction is supported by federal funding and is scheduled for
2008 construction. The project limits are to begin east of Peterson
Drive and extend to Home Street, including Line Street. Reviewed by the
Public Works/Finance Department on July 24, 2006.
ACTION: Approve contract with Archaeological and Historical
Services.
F. 2006 Overlay Project Funding Reallocation - Les MacDonald
The City of Moscow has been developing an overlay project for Arterial
and Collector streets utilizing grant funds received from the Idaho
Transportation Department (ITD) and administered by the Local Highway
Technical Advisory Council (LHTAC). ITD opened bids for the project in
late June and determined that the one bid received was over the project
budget. In order for the project to precede additional local match
funding will be necessary in order to make up the difference between the
amount of grant funds available and the bid amount. The City of Moscow
would need to provide approximately $80,000 in additional up front
funding for the project. Staff recommendation is to proceed with the
project as bid by providing additional local match funding from the 2007
Annual Overlay budget funds via a short term fund loan from the Mountain
View Road Improvements budget item in the Capital Projects Fund. This
is based on the likelihood that the prices for the work will not
decrease through a re-bid or a delay in the project. Reviewed by the
Public Works/Finance Committee and Administrative Committee on July 24,
2006.
ACTION: Appove2006 Overlay Project funding reallocation.
2. Mayor's Appointments - Mayor Chaney
Mayor Chaney proposes appointing Valeri Shillberg to the Planning and
Zoning Commission.
ACTION: Approve appointment or take such other action deemed
appropriate.
3. Public Comment and Mayor's Response Period (limit 15 minutes)
- For members of the Public to speak to the Council regarding matters
NOT on the Agenda and not currently pending before the Planning and
Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes. Mayor will
respond to comments from previous meeting.
4. Discussion and Public Input Regarding Fee Increases Over 5% -
Don Palmer
Staff prepared the proposed FY 2006-2007 Fee Resolution. According to
Idaho law, a public hearing must be held if individual fee increases
exceed 5% of the previous year. Due to a publication error, the public
hearing will be held on August 21st. However, the Mayor wants to
provide the public an opportunity to comment on the proposed Resolution
prior to consideration of the Appropriations Ordinance. The FY 2007
budget proposal is based on this Resolution. Increases of 5% or greater
include: water, sewer and sanitation utility fees; all new Community
Development fees; engineering fees; most license fees; Farmers' Market
fees; and all Parks and Recreation's existing, new and special program
fees as detailed on the Resolution.
ACTION: Consider public input.
5. Public Hearing - Adopting of Appropriations Ordinance - Don
Palmer
The City of Moscow's 2006-2007 Fiscal Year annual budget is being
proposed in the amount of $46,940,245. The City Council heard the
Mayor's proposed budget for fiscal 2007 at the budget workshop held on
July 18th and 19th, 2006. City Council approved the Mayor's proposed
budget with staff and Council recommended changes.
ACTION: Approve the Ordinance under suspension of the rules
requiring three complete and separate readings and that it be read and
published by title only; or consider the Ordinance on first reading; or
reject the Ordinance; or take such other action deemed appropriate.
6. Public Hearing - Kirkland Annexation, Comp Plan Amendment,
Rezone - Andrew Ackerman
On May 24, 2006 the Planning & Zoning Commission recommended denial of
annexation, zoning, and Comp. Plan Map designation for approximately
4.91 acres of county island, described as the Kirkland Addition and
located on W. Palouse River Drive, east of the UI arboretum. The Council
committees received the Planning & Zoning recommendation on June 12,
2006 and approved of an August 7th, 2006 hearing date to consider the
matter. The annexation of the property was initiated in conformance with
City of Moscow Resolution 2001-15 which states that property that is
located adjacent to the City shall be annexed when the property is
completely surrounded by the City on all sides. Idaho Code
50-222(50)(b)(iv) further states that when annexing a property, Council
shall consider the appropriate zoning and comprehensive plan
designation(s) for the subject lands.
ACTION: 1. Approve the Annexation Ordinance under suspension of the
rules requiring three complete and separate readings and that it be read
and published by title only; or consider the Ordinance on first reading;
or reject the Ordinance; or take such other action deemed appropriate.
2. If number 1 is completed, the approve the Resolution amending Comp
Plan; or reject the Resolution; or take such other action deemed
appropriate. 3. If action number 2 is completed, then approve the
Zoning Ordinance under suspension of the rules requiring three complete
and separate readings and that it be read and published by title only;
or consider the Ordinance on first reading; or reject the Ordinance; or
take such other action deemed appropriate.
7. Public Hearing - Proposed Zoning Code Definitions Amendments
Relative to Clarify Boarding House Issues - Joel Plaskon
The Administrative Committee requested the City Attorney's office to
provide a report regarding various complaints and issues related to
boarding house and residential occupancy situations. The Administrative
Committee directed staff to develop and forward clarifying Code
amendments to the Planning and Zoning Commission for public hearing and
recommendation to Council. The Commission conducted their hearing and
recommended approval of the related code amendments on June 28, 2006.
The proposed code amendments are intended to help clarify code
interpretation and related administration relative to occupancies and
definitions for Bed and Breakfast Inn, Boarding House, Single Family
Dwelling, Dwelling Unit and Family. This has been reviewed by the
Administrative Committee.
ACTION: Approve the Ordinance under suspension of the rules requiring
three complete and separate readings and that it be read and published
by title only; or consider the Ordinance on first reading; or reject the
Ordinance; or take such other action deemed appropriate.
8. Diversity Resolution - Linda Pall
In accordance with the City's continual efforts to promote equality,
diversity and human rights in Moscow, the Mayor and Council President
are proposing the passage of the attached Diversity Resolution and
proposed Race Equality Week. The proposed Resolution would reaffirm the
City's commitment to this critical issue and would designate the week of
September 25th, 2006 as Racial Equality Week in cooperation with the
National League of Cities Partnership for Working Toward Inclusive
Communities initiative.
ACTION: Approve Resolution; reject Resolution; or take such other
action deemed appropriate.
