MOSCOW CITY COUNCIL

REGULAR MEETING

Monday, October 17, 2005

The Moscow Mayor, City Council and staff welcome you to tonight's
meeting.  We appreciate and encourage public participation.  For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report.  However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments.  Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 2 after the Consent Agenda.  If you plan to address the Council,
you will find a list of "Tips for Addressing the Council" on the table
outside the City Council Chambers.  Thank you for your interest in City
government.

PLEDGE OF ALLEGIANCE

 
PROCLAMATION - Confluence of Traditions Month
 
1.         Consent Agenda:  Any item will be removed from the consent
agenda at the request of any Councilmember and that item will be
considered separately later.  Approval by roll call vote.
 
A.     Approval of Minutes of October 3, 2005 - Stephanie Kalasz
 
            B.   Rolling Hills 7th Addition Development Agreement - Dean
Weyen
Rafik and Mary Sue Itani are developing a subdivision to be known as
Rolling Hills Seventh Addition and numerous public improvements are
required.  A Development Agreement is necessary to allow filing of the
plat and issuance of a building permit prior to the construction of
public improvements.  Engineering design plans for Phase I of the public
improvements have been submitted and approved.  Reviewed by the Public
Works/Finance Committee on October 10, 2005.
 
                  ACTION:  Approve the development agreement.
 
            C.   Changes to Fee Resolution - Don Palmer
When staff prepared the FY 2006 Fee Resolution, six inconsistencies were
noticed and we recommend changing the fees to more accurately reflect
the cost of delivery of services.  There are six changes necessary.  A
public hearing is not required because changes do not exceed 105% of
previous rates.  Reviewed by the Administrative Committee on October 10,
2005.
 
                  ACTION:  Approve Fee Resolution 2005-11 changing
Resolution 2005-10.
 
2.         Public Comment Period - For members of the Public to speak to
the Council regarding matters NOT on the Agenda and not currently
pending before the Planning and Zoning Commission or Board of
Adjustment, please state your name and address for the record and limit
remarks to three minutes.  Time limit 15 minutes. 
 
3.         Public Hearing - Rezone at 122 & 204 S. Van Buren and 504 &
510 Third St. (denied at P&Z) - Andrew Ackerman
The property owners of four (4) residential lots on the northeast corner
of Third Street and Van Buren have requested that their properties be
rezoned from Medium Density Residential Zoning District (R-3) to
Multiple Family Residential (R-4) Zoning District.  The Planning and
Zoning Commission conducted a public hearing and recommended denial of
the subject rezone application on August 24, 2005.
 
           ACTION:  Approve Ordinance under suspension of the rules
requiring three complete and separate readings and that it be read and
published by title only; or reject the Ordinance; or take such other
action deemed appropriate.
 
4.         Rolling Hills 7th Addition Final Plat - Andrew Ackerman
Rafik and Mary Sue Itani request final plat approval for Rolling Hills
7th Addition located east of Sixth Street and north of Panorama Drive.
Council approved the preliminary plat of the property on July 6, 2004
with three (3) conditions as suggested by staff. The Planning and Zoning
Commission recommended approval of the final plat on September 28, 2005
and determined that the conditions have been met. The final plat is
scheduled to go before Council on October 17, 2005.  Reviewed by the
Public Works/Finance Committee on October 10, 2005.
 
ACTION:  Approve the final plat with or without conditions; reject the
final plat; or take such other action deemed appropriate.
 
5.         2nd Reading of Ordinance for West 10 Feet of Harrison Street
ROW Vacation - Les MacDonald
The owners of the property located on the west side of Harrison Street,
between Eighth Street and Lewis Street, have requested that ten feet of
right-of-way be vacated.  The franchise utilities have been notified of
this proposed right-of-way vacation request and their responses
regarding the existence of their facilities are attached for reference.
City Water, Sewer, and Streets Departments have also provided comments.
In 1987, the west ten feet of right-of-way on Harrison Street, between
Sixth Street and Eighth Street, was vacated to the property owners.  The
currently requested vacation is consistent with the vacation granted in
1987.  Considered by Council on first reading on October 3, 2005.
 
ACTION:  Approve Ordinance under suspension of the rules requiring three
complete and separate readings and that it be read and published by
title only; or consider the Ordinance on 2nd reading and that it be read
by title only; or reject the Ordinance; or take such other action deemed
appropriate.
