The Moscow Mayor and City Council welcomes you to tonight's meeting. We
appreciate and encourage public participation. For regular agenda
items, an opportunity for public comment is sometimes provided after the
staff report. However, the formality of procedures varies with the
purpose and subject of the agenda item; therefore, the Mayor may
exercise discretion in deciding when to allow public comment during the
course of the proceedings and limitations will be placed on the time
allowed for comments. Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 2 after the Consent Agenda. If you plan to address the Council,
you will find a list of "Tips for Addressing the Council" on the table
outside the City Council Chambers. Thank you for your interest in City
government.
PLEDGE OF ALLEGIANCE
1. Presentation of Jon Kimberling as Mayor's Appointment to
Vacant City Council Position

C. Renewal of Secondhand Dealer Licenses for 2005 -

Thomas Uribe of Moscow Pawn and Darlene Hylton of Now and Then have
applied for renewal of their Secondhand-Pawn License for 2005. The
Police Department has recommended approval of the license.
ACTION: Approve the renewal of Secondhand-Pawn Licenses for Thomas
Uribe and Darlene Hylton.
D. Award of Bid for Custodial Services - Roger
Blanchard
Three proposals were received for professional janitorial services for
City buildings including City Hall, the Police Station, the Paul Mann
Building, the Youth Center, the Hamiliton Indoor Recreation Center, Fire
Station #3, and the 1912 Center. ServiceMaster Building Maintenance
submitted the low bid; American Building Maintenance and Western
Building Maintenance submitted the next lowest bids, respectively.
ServiceMaster is currently the custodial services provider for the City.
Proposals were submitted for a three-year period ending September 30,
2007 and included monthly costs for each of the City buildings for each
of the three contract years. Staff is requesting authorization to enter
into a contract with ServiceMaster for the Mayor's signature.
ACTION: Authorize staff to enter into a contract with ServiceMaster
Building Maintenance.
3. Public Comment Period - For members of the Public to speak to
the Council regarding matters NOT on the Agenda and not currently
pending before the Planning and Zoning Commission or Board of
Adjustment, please state your name and address for the record and limit
remarks to three minutes. Time limit 15 minutes.
4. Rezone & Preliminary Plat 1025 N. Mountain View Road
(Slonaker) - Joel Plaskon
The Council conducted a public hearing on November 15, 2004 to rezone
1025 N. Mountain View Road from Suburban Residential (SR) Zoning
District to Low Density Single Family Residential (R-1) Zoning District.
The motion to pass the related Ordinance (under suspension of the rules
requiring three complete and separate readings and that it be read by
title only) was not valid because the vote was three to two. Such a
motion requires a vote of one half plus one members of the full Council.
Consequently, the passage of the preliminary plat was not valid because
the property had not been properly rezoned. Staff is returning the
rezoning ordinance to the Council for consideration on third reading and
if the rezone is approved, staff will also request a subsequent vote to
approve the preliminary plat. These subsequent actions are based upon
the record made at the public hearing on November 15, 2004 and no
additional public testimony will be taken. The Rezone Ordinance was
approved on second reading at the Council meeting on December 6, 2004.
ACTION: A. Approve the Ordinance on third reading; or take
such other action deemed appropriate;
B. Approve or deny preliminary plat or take such other action deemed
appropriate.
5. Parade Ordinance - Randy Fife
In order to provide for a predictable, fair and reasonable application
process for parades and public assembly permits within the City, the
Ordinance proposed sets out the application process, standards to be
met, fees, an alternative permit process, and appeals procedures. These
elements are designed to balance the City's need to control its public
streets, to promote public health and safety, and the right of all
citizens to exercise their freedoms under the U.S. and Idaho
Constitutions. Reviewed by the Administrative Committee on November 8
and 22, 2004.
ACTION: Approve Ordinance under suspension of the rules
requiring three complete and separate readings and that it be read by
title only; or reject the Ordinance; or take such other action deemed
appropriate.
6. Ordinance Changing Moscow City Code 2/2/16 and 2/2/17
Earlier this spring, the City Council directed that Council
Administrative and Public Works/Finance Committee meetings would be held
on the 2nd and 4th Mondays of the month. This arrangement has continued
since that time and appears to be working well. Moscow City Code 2-2-16
and 2-2-17 state that these Committee meetings shall occur each week.
The attached Ordinance removes that language and allows the Council to
set these meetings in its discretion, giving public notice as required
by Idaho Code. This matter was reviewed and unanimously recommended for
approval by the Administrative Committee on December 13th, 2004.
ACTION: Approve Ordinance under suspension of the rules requiring three
complete and separate readings and that it be read by title only; or
reject the Ordinance; or take such other action deemed appropriate.
7. Memorandum of Understanding with the Latah Economic
Development Council - Gary J. Riedner
The City of Moscow has worked with the Latah Economic Development
Council in the past for economic development services. During the
Council workshop for the budget, the Council indicated its desire to
formalize the relationship with LEDC, describing economic development
services to the City. The attached Memorandum of Understanding
formalizes the services to be provided, the compensation for those
services and responsibilities of the parties. This item was recommended
for approval at the November 22, 2004 Public Works/Finance Committee
meeting and was presented to the LEDC Board. They requested
clarification of some sections and those have been integrated into the
attached draft.
ACTION: Approve the Memorandum of Understanding or take
such other action deemed appropriate.
