The defendants of the Nurnberg trials were charged with crimes against
humanity (i.e. the systematic slaughter of 6 million Jews).  Not one
defendant was charged with any "murders" as a result of armed conflict.  I
believe that it is fair to say that in the absence of "crimes against
humanity" (the atrocities that occurred in prison camps in Iraq come to
mind), national leaders at the conclusion of armed conflicts will not be
tried for murder.
