John- in response to your question dated 2/27(shown below), this is what =
I got from Randy Fife:

While the proposed ordinance does not specifically impact homes,it does =
regulate the public rights-of-way. This means that some portions of =
yards and of sidewalks would be affected. There is no standard ROW width =
so the encroachment of the ROW varies throughout the town. The City has =
a number of ordinances which regulate the public ROW.=20

As it stands now, the proposed vendor ordinance applies throughout the =
City. It could be written to apply to various parts of the city, certain =
zoning districts, certain streets, or some other way.

A question was also asked how this ordinance would deal with kids =
selling lemonade. I believe, if we adopt an ordinance, it is critical =
that we have the flexibility to find a practical application for this =
situation. It could also apply to girl scouts.

Again, I appreciate the questions. You've made me think of some aspects =
of this that I might not have considered. Please keep the questions =
coming. Lastly, I have not heard when this will get back on the =
Administrative Committee agenda so keep an eye on Chris Bainbridge's =
postings.

    Does the public right of way extend into the front yards of many of =
the homes in Moscow?  I am trying to remember something from either tree =
or sidewalk issues.  If my sometimes poor memory is correct, the public =
right of way can extend well into the front yard, past the sidewalk.
