<BODY><!--StartFragment --> To all parents and friends of the Moscow School District -- <BR><BR>By now, most of you have heard about the lawsuit filed by Gerald Weitz <BR>against the Moscow School District. We wanted to provide you with a <BR>quick overview of the situation: <BR><BR>The complaint questions the validity of the supplemental levy <BR>elections back to 1992. The lawsuit was filed in the District Court on <BR>May 3, 2007 and papers were served to the Moscow School District <BR>office on Monday, May 7, 2007. By law, the school district has 20 <BR>days to respond to this complaint and request a hearing. The law <BR>states that there is a 30 day window from the date the defendant (MSD) <BR>is served with the complaint to be in front of a judge. (This makes <BR>the hearing deadline June 6, 2007.) The judge has to hear arguments <BR>by or on that date. <BR><BR>Lawyers for the MSD are currently preparing the District's defense. <BR>
MSD personnel have told us that for all elections, the same Board <BR>Resolution language and ballot language were used. The District had <BR>legal counsel review the ballot language prior to the election. <BR><BR>At this point, the Superintendent has frozen budgets for all units in <BR>the District. All money saved will go towards deflecting budget cuts <BR>in the 07-08 budget. Unfortunately, this means that money is no longer <BR>available for end of the year purchases. However, the Superintendent <BR>has told us that some academic field trips and the rites of passage <BR>events, such as graduation ceremonies and the senior sneak, will be <BR>held. <BR><BR>If you would like to view the complaint and the Idaho Code chapter <BR>upon which the complaint is based you may request copies from your <BR>school's Parent Teacher Organization, Parent Advisory Team, or Parent <BR>Support Team leader.
