<i>J.B.D. Construction, Inc. v. Mid-Continent Casualty Company, Inc.</i>, 2014 WL 3377690 (11<sup>th</sup> Cir. July 11, 2014), which we will discuss during the CLE portion of the call.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:12.0pt">The <i>J.B.D.</i> decision is another case interpreting the
<i>J.S.U.B.</i> and <i>Auchter</i> line of cases regarding coverage under a standard CGL policy for construction defects. In
<i>J.B.D.</i> the 11<sup>th</sup> Circuit found that there was a duty to defend but not a duty to indemnify. The court found that the insurer breached its duty to defend, and remanded to the District Court to determine the amount, if any, of consequential
damages. It is instructive on how to plead a complaint to at least trigger the duty to defend.<o:p></o:p></span></p>
