Reminder – Next Zoom Monthly ISC Membership Meeting Monday, March 17 at 12PM.
Latest update on the proposal for the creation of the Florida Bar Insurance Coverage Law (“ICL”) Board Certification:
1. The Florida Bar Board of Legal Specialization and Education Committee (“BSLE”) has given its FINAL APPROVAL!
* See the attached letter from the BSLE Chair, Judge Kansas Gooden.
* Special Thanks to ISC members: Reed Grimm, Michael Cassel, Mark Boyle, and Wendy Stein Fulton for appearing in person with me before the BLSE on January 24!
* In the BLSE letter, you will notice mention about one part of the proposal pitch that was not approved which was about increasing the total years of practice before being able to seek board cert from 5 years to 7 years. So, while we tried to RAISE the standard, because every other board cert only requires 5 years, the BSLE rejected our attempt to increase to 7 years (which we even mentioned to the BSLE that perhaps all the board certs need to increase from 5 years to 7 years). So, on this point – we tried.
1. The steps on creating a new board cert are pasted below (from the Bar’s website - though the information is somewhat incomplete).
* Since the August 2024 ICL proposal submission, we have completed Steps 1, 2 and 3, with Step 4(a) next up:
i. BOG’s Program Evaluation Committee (“PEC”).
* The next BOG meeting is on Friday, March 28 in Tampa, which means the PEC will likely be meeting on Thursday, March 27, but we have not yet received an invitation or any word from the PEC, though some feelers have been put out there!
1. How can you help?
* Reach out to your local BOG reps. Here’s a link. The Florida Bar Board of Governors<https://www.floridabar.org/about/bog/>
* Write letters of support to your BOG reps and cc it to all the BOG reps.
* Talk to incoming Bar president, Sia Baker Barnes, about the ICL proposal, as this will likely be considered by the entire BOG during her presidency.
1. How much longer will this take?
* Given that the proposal needs to go through 2 readings before the BOG and Steps 5-6 (below), the best guess is 12 to 18 months from now. Certainly, Step 4(a) through 4(d), will likely take all of 2025 to get through.

DONE Approval of Proposed Standards by Board of Legal Specialization & Education (BLSE) Rules Committee (presented in a rule amendment format consistent with all other area standards in Chapter 6, R. Regulating The Florida Bar, and in compliance with the minimum standards for board certification in Sub Chapter 6-3.)
1. DONE Approval of Proposed Standards by BLSE (includes determination as to whether any existing Bar Sections should be asked to provide)
1. Approval of Proposed Standards by:
* Program Evaluation Committee (PEC) of the Board of Governors (BOG)
* Budget Committee of the BOG
* Rules Committee of the BOG
* BOG (two readings)
1. Notice to the Bar membership must occur prior to final action by the BOG and prior to filing with the Supreme Court of ... {Florida Bar Website has incomplete info}….
1. Submission to the Supreme Court as an amendment to the Rules Regulating The Florida Bar. (Bar Rule amendments are filed )
1. Upon approval by the Supreme Court, a notice will be placed on the Bar’s website and in the Bar News to advise the membership and to elicit members to apply for service on the inaugural nine-member certification committee.
* Pursuant to Rule 6-3.2, initial appointees shall be “eminent attorneys” in the field and shall be members in good standing of The Florida Bar admitted no less than 10 years. Appointments are made by the President of The Florida Bar. The three-year terms are staggered and each member is certified by virtue of ... {Florida Bar Website has incomplete info}….
